Council <br />Hilo, Hawaii 96720 <br />Your Committee on Planning, to which was referred Bill No. 42, reports as follows: <br />Bill No. 42, transmitted by Mayor William P: Kenoi, via Communication No. 159 dated <br />March 17, 2011, is an Ordinance amending Ordinance No. 03 -162 which amended Ordinance <br />No. 91 -9.1, which changed the district. classification from Agricultural 1 acre (A -la) to Village <br />Commercial -1 acre,(CV —1a) at H6lualoa lst and .2 "d, North Kona, Hawaii, Covered Tax Map <br />Key: 7- 6- 008:005 (portion). This project area is situated along the makai side of the MamalahoIa <br />Highway; the applicant, H61ualoa Inn, is requesting an amendment to Condition B (complete <br />construction) to allow for an additional five years to secure final plan. approval and complete <br />construction of the proposed commercial development on the project site. <br />Planning Program Manager Daryn Arai explained that due to current economic conditions, the <br />applicant has reassessed, reevaluated, and revised its original concept from building a restaurant <br />to building an events pavilion. He added that the Leeward Planning Commission has made a <br />positive recommendation. <br />Ms. Ford has concerns regarding the original access to the property from parcel 24 and 27; <br />however parcel 27 no longer exists. She asked Mr. Arai to explain where the access would be <br />once it is rezoned. Mr. Arai explained parcel 27 has been consolidated and is now identified <br />collectively as parcel 5 and will support an amendment of the bill to eliminate reference to parcel <br />27. He also stated that the access is in parcel 5 but could be relocated in the future if <br />improvements to the Mamalahoa Highway might allow for improved sight distance. <br />Ms. Ford also questioned ownership of parcel 24 and preservation of the existing foot trail. <br />Noelani Ubaldo spoke on behalf of the owners of H61ualoa Inn and affirmed that they also own <br />parcel 24 and planned on preserving the foot trail. Councilmember Ford also asked about the <br />allowable density and Ms. Ubaldo stated that they currently have 6 units and originally requested <br />to add an additional 4 units plus a restaurant; however, at this time they are only seeking to build <br />a pavilion and not to add additional rooms or a restaurant. <br />Mg. Ford also voiced, confusion regarding Section I, concerning no increase in density beyond <br />the maximum of five units and.suggested,the original Special Permit be cancelled.
