Hawaii County is an Equal Opportunity Provider and Employer Ref. o•l• IIMY 31 2011 PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, DEPARTMENT OF PUBLIC WORKS DRAFT 2, BILLS 270 (THE INTERNATIONAL BUILDING CODE 2006 EDITION ), 269 (2006 UNIFORM PLUMBING CODE) AND 268 (2008 NATIONAL ELECTRIC CODE) WHY DO WE NEED A UNIFORM CODE? • Consistency - Each county has a different set of provisions regarding building codes. This results in hardship for those involved in building ownership, design, construction, and insurance. • Synergy - The new code is better organized, clearer, and more comprehensive. • Health and Safety - The new code has higher standards relating to emergency preparedness and design criteria. It is better adapted to protecting public welfare. • Mandate - The County of Hawaii has been mandated by Act 82 to adhere to a uniform statewide building code. • PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, ACT 82 BACKGROUND, REQUIREMENTS, AMENDMENTS AND PROHIBITIONS BACKGROUND • Act 82 SLH 2007 was signed by then Governor Lingle on 5/21 /2007 to establish a state building council (SBCC) tasked with the creation of a comprehensive state building code. Act 82 expresses concern over The status of fragmented building requirements in Hawai`i." (section 1.) 5/31/2011 `a. w PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, Requirements A state building code shall include • The latest edition of the state fire code as adopted by the state fire code council." • "The latest edition of the Uniform Plumbing Code" (UPC) • "The latest edition of the International Building Code" (IBC) It also requires design standards relating to: • "Emergency shelters being built in compliance with hurricane resistant criteria" • "Essential government facilities requiring continuity of operations" • "Code provisions based on nationally published codes or standards" such as energy conservation standards, hurricane resistance criteria, onsite sewage disposal etc. • "Each county shall use the model codes and standards listed in section 107 -E, as the referenced model building codes and standards for its respective county building code ordinance..." Requirements continued "The governing body of each county shall amend the state building code as it applies within its respective jurisdiction" in accordance with section 46.1.5 (13). This can be done without approval of the state building code council. (section 107 -H). Plumbing and electrical codes must be passed 30 days prior to the April 16, 2012 deadline in order to take effect by this date. This is within the jurisdiction of the counties. Administration relates to permitting, enforcement, and inspection procedures. 5/3! ? 1 METHODOLOGY The information presented is based on the questions, statements, and concerns voiced at public meetings held by the state building code council in 2009, by the Hawai'i County Council and Department of Public Works in 2010. This discussion included: 5/31/2011 1 PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, METHODOLOGY CONTINUED • Design Professionals (structural engineers, architects, etc.) • Owner builders (homeowners) • Contractors (electricians, plumbers, etc.) • Realtors • Home Planning Consultants • Lenders /Mortgage Brokers • Developers and Management companies • Home Planning Consultants PUBLIC CONCERNS PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, EMERGENCY SHELTERS SAFE ROOM Act 82 requires design standards relating to "Emergency shelters being built in compliance with hurricane resistant criteria" It does not mandate the use of a residential safe room, but if one is installed, it must adhere to the requirements set forth by Public Works draft 2 Bill 270, section 422. The Department of Public Works proposes that there be 3 ways in which R -3 structures can adhere to the these requirements: 1. Protect all windows of the home with impact resistive glazing or impact protective systems 2. Protect all windows of the home using pre -cut plywood sheets 3. Add pre - installed permanent attachments on the walls and design the home for partially enclosed conditions and provide one safe room. These options accommodate a range of costs. /31/5011 INSPECTIONS • A request for scheduled inspection must be filed with the inspector not less than 48 hours and no more than 72 hours by fax, email, or phone call. • The inspector has 48 hours excluding holidays and weekends to respond. • If the building inspector does not keep to the schedule or if the area to be inspected is covered or concealed, a Hawaii State licensed contractor in a letter to Public Works verifies the project meets the current codes. • The letter must be stamped and signed. 5/31 /'2(11 1 PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, PERMITS • If you have a present permit, and the new building code ordinance takes effect, you can operate under your existing permit. • Under the proposed ordinance, if work does not commence within 120 days a new permit must be obtained. If the work has commenced but is not completed within 3 years, a new permit must also be obtained. • No increase in permit fees (section 5 -31) 5/31 / J1I TRANSFER OF PERMITS • No permit can be transferred, loaned, or assigned to another by another permittee. • This also applies to all building permits issued prior to the adoption of this code. • Purpose is to avoid administrative and legal complications in terms of liability as well as to promote public safety. 201 PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, VIOLATIONS & ENFORCEMENT • In order to aid enforcement, noncompliance with the provisions of the code can only be considered a petty misdemeanor. PUBLIC CONCERNS NATIONAL ELECTRICAL CODE DRAFT 2 BILL 268 31/2011 PPP FOR THE PUBLIC WORKS AND PARKS AND RECREATION COMMITTEEJ UNE 14, WHY ARE WE ADOPTING A CODE THAT IS ALREADY SUPERSEDED? The State Building Code HAR, Title 3, Chapter 180, Subchapter 2, determines the code cycle that we should be enforcing. Section 3- 180 -46 states that the effective date of this Electrical section is April 16, 2010, which refers to the 2008 National Electric Code (NEC).
