No. 211 /Res. 79 -11 <br /> PLACE: Council Chambers <br /> Hilo, Hawai`i <br /> TIME: 1:33 p.m. <br /> Council Chair and Members <br /> Hawai`i County Council <br /> Hilo, Hawai`i 96720 <br /> Your Committee on Finance, to which was referred Resolution No. 79 -11, reports as follows: <br /> Resolution No. 79 -11, transmitted by Deputy Corporation Counsel, Ivan Torigoe dated May 12, <br /> 2011, authorizes the acquisition of private property (TMK: (3) 9 -2- 150 -060) by eminent domain <br /> for construction of the Ocean View Recycling Point and Convenience Center in Ocean View, in <br /> the District of Ka`u, County and State of Hawai`i <br /> This parcel of property containing an area of 21.6397 acres, more or less, and together with a <br /> One Twenty- Second (1/22) undivided interest in Lots 23 and 24 (Roadway Lots, areas 12.7739 <br /> and 15.9487 acres, respectively, TMK 9 -2 -150 — portion of 066). <br /> The acquisition of this parcel is required by the County to construct and operate the Ocean View <br /> Recycling and Transfer Station, also known as the Ocean View Recycling Point and <br /> Convenience Center, which improvements generally consist of grading and site improvements, <br /> construction and operation of a State of Hawai`i Department of Health permitted recycling and <br /> solid waste transfer station. <br /> Ms. Smart urged the support of Your Committee, stating the need for a transfer station in Ocean <br /> View and importance on acquiring this property. <br /> A proposed amendment was transmitted via Communication 211.1 from Council member <br /> Brenda J. Ford, dated May 27, 2011. Ms. Ford commented that the compensation amount is <br /> included in this amendment. <br /> The amendment, as amended, was carried. <br /> Department of Environmental Solid Waste Engineer, Terin Gloor appears before Your <br /> Committee with a brief power point presentation with images representing parcel location with <br /> surrounding residences, developments etc. It was clarified that this parcel totals approximately <br /> twenty -two acres of which nine is designated for this project. <br /> Pursuant to Section 101 -13 of the Hawai`i Revised Statutes requires that a condemnation action <br /> by the County of Hawai`i must be authorized by a resolution of the County Council. <br /> FC Rept.
