No. 225/ Bill No. 59 <br />PLACE: Council Chambers <br />Kona, Hawaii <br />TIME: 10:30. a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Committee on Planning, to which was referred Bill No. 59, reports as follows: <br />Bill No. 59, transmitted by Mayor William P. Kenoi, via Communication No. 225 dated <br />May 24, 2011, is an Ordinance amending Ordinance No. 03 -82 which amended Section 25 -8 -33 <br />(City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County Code, by <br />changing the District classification from Limited Industrial- 20,000 Square Feet (ML -20) to <br />Industrial- Commercial Mixed Use - 20,000 Square Feet (MCX -20) at Waiakea, South Hilo, Hawaii, <br />covered by Tax Map Key 2 -2- 035:061. <br />Bill 59 proposes an amendment to Condition F to allow the applicant to dispose of development <br />generated waste in a manner meeting with the approval of the State Department of Health due to the <br />absence of a sewer line in close proximity to the property and also proposes some housekeeping <br />amendments, such as an amendment to Condition C to preserve the original compliance deadline. <br />Councilmember Ford reviewed the map and noted it appeared that this was in an area of urban <br />development and wondered if it would be more appropriate to install the needed sewer line. She <br />confirmed the current zoning and asked if a sewer line is installed in the future if the applicant <br />would be required to connect to it. <br />Councilmember Yagong asked if any of the nearby properties had been required to connect to sewer <br />lines. <br />Committee Chair Hoffmann discussed how the change in zoning classification would change the <br />wastewater generated. <br />Planning Director Leithead Todd stated that the lots have various owners and it is not typical to <br />request sewer lines to be installed unless there is a large development in the area. Director Leithead <br />Todd stated that this applicant isn't the first not required to connect to a sewer line and confirmed <br />the applicant would be required to connect if a sewer line is installed in close proximity in the <br />future. <br />PC Rept.
