COUNTY OF HAWAII : ., '� + 8(, � . �•I STATE OF HAWAII • — off, `, Ni M RESOLUTION NO. 99 11 A RESOLUTION OF DETERMINATION TO PROCEED TO CREATE AND DEFINE A WATER SYSTEM IMPROVEMENT DISTRICT FOR THE KONA OCEAN VIEW PROPERTIES SUBDIVISION WHEREAS, on May 17, 2011, the Hawai`i County Council adopted Resolution No. 74- 11, a Resolution Rescinding Resolution No. 41 -11 and to Propose the Establishment of a Water System Improvement District for the Kona Ocean View Properties Subdivision; and WHEREAS, Resolution No. 74 -11 expressly approved and adopted the findings, conclusions and recommendations contained in the Manager's Report, Communication No. 989 received on October 22, 2010 (the "Manager's Report"), prepared by the Manager -Chief Engineer of the Department of Water Supply (the "Manager ") with respect to a proposed water system improvement district (the "Improvement District ") for the Kona Ocean View Properties Subdivision (the "Subdivision "); and WHEREAS, in adopting Resolution No. 74 -11, the Council concurred with the Manager's conclusion that "the establishment of the Improvement District will provide significant benefits to the health, safety and welfare of the residents of the Subdivision" and found that, in accordance with Section 12- 10(i), Hawai`i County Code 1983 (2005 Edition, as amended), the creation of the proposed Improvement District and the construction, acquisition and installation of a water system for the Improvement District was in the public interest; and WHEREAS, by letter dated January 31, 2011, a copy of which was attached as Exhibit B to Resolution No. 74 -11, the Director of the Department of Public Works advised the Manager that involvement of the Department of Public Works is not required because the proposed project is strictly a water system within a private subdivision and the subdivision roads are privately owned; and WHEREAS, Resolution No. 74 -11, in accordance with the provisions of Section 12 -10 of the Hawai`i County Code 1983 (2005 Edition, as amended), authorized a public hearing on the proposed improvements to be held within 45 days after its adoption; and WHEREAS, in accordance with the requirements of public notice set forth in Section 12 -10, Hawai`i County Code 1983 (2005 Edition, as amended), the Office of the County Clerk undertook the following steps to notify owners of properties subject to assessment and owners of properties proposed for acquisition as contemplated in Resolution No. 74 -11 of the date, time and place of the Public Hearing: (1) Set a Public Hearing to be held on June 14, 2011 at 6:00 p.m. at the West Hawai`i Civic Center in Kailua -Kona, Hawai`i; (2) Mailed copies of the Notice of Public Hearing (in the form attached to this resolution as "Exhibit A ") by certified and regular mail to each of the 81 owners of assessment units within TMKs 7 -2- 008:1 -41 (excluding lot 39, which is not part of the Subdivision) and TMKs7 -2- 09:1 -42 (excluding lot 41, which is the road lot) on May 26, 2011 and May 31, 2011; (3) Published the Notice of Public Hearing in two newspapers of general circulation within the County (West Hawai`i Today and Hawai`i Tribune Herald) twice a week for two successive weeks (on May 25, May 27, June 1 and June 3, 2011), as to which notarized affidavits of publication have been duly filed and received from such newspapers; and (4) Posted the Notice of Public Hearing on June 2, 2011 at the West Hawai`i Civic Center in Kailua -Kona, Hawai`i, and the Hawai`i County Building in Hilo, Hawaii; and WHEREAS, the Notice of Public Hearing stated, among other things, that Resolution No. 74 -11, the Manager's Report (Communication No. 989 dated October 21, 2010), including Exhibits "A" through "E" may be seen and inspected at: (1) the Office of the County Clerk, Hilo, Hawai`i, (2) the West Hawai`i Civic Center, Building A, Kailua -Kona, Hawai`i, and (3) the Office of the Mayor, West Hawai`i Civic Center, Kailua -Kona, Hawai`i; and WHEREAS, pursuant to the requirements of Section 12- 10(e), Hawaii County Code 1983 (2005 Edition, as amended), the Notice of Public Hearing explicitly advised all owners of assessment units within the Improvement District that "a protest against making all or part of the proposed improvements or against the methods by which such assessments are to be made, or the inclusion of certain costs therein must be submitted in writing to be considered by the Council," and further directed that such written protests or objections were required to be mailed to the County Clerk prior to the Public Hearing and postmarked on or before June 14, 2011 or submitted in person prior to adjournment of the Public Hearing; and WHEREAS, thirteen residents of the Subdivision attended the Public Hearing; and WHEREAS, all persons in attendance at the Public Hearing were invited to offer verbal testimony relating to the Improvement District and to submit written testimony to the Office of the County Clerk for purposes of recordation and further consideration by the County Council; and WHEREAS, to answer any questions relating to the Improvement District proposed in Resolution No. 74 -11, the following county departmental personnel and consultants were present at the Public Hearing: Milton Pavao, Manager -Chief Engineer, Department of Water Supply; Kanani Aton, Public Information and Education Specialist, Department of Water Supply; Ryan Quitoriano, Project Engineer, Department of Water Supply; Michael Okumoto, Treasurer, Department of Finance; Katherine A. Garson, Assistant Corporation Counsel, Office 2 of the Corporation Counsel; Nancy E. Burns, P.E. , LLC, Project Design Engineer; and Jamae K.K. Kawauchi, County Clerk; and WHEREAS, testimony for and against the proposed Improvement District was heard by the Council at the Public Hearing and the audio -taped proceedings of the Public Hearing have been subsequently transcribed (attached to this Resolution as "Exhibit B "); and WHEREAS, the County Clerk has advised the Council that written protests were timely received from the owners of four (4) assessment units within the proposed Improvement District, copies of which are attached to this Resolution as "Exhibit C;" and WHEREAS, the written protests received from owners of assessment units constitute less than fifty percent of the total number of assessment units (81) in the proposed Improvement District and, in accordance with Sections 12 -12 and 12 -17, Hawai`i County Code 1983 (2005 Edition, as amended), Council may proceed to approve the proposed improvement by assessment. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII AS FOLLOWS: 1. Certain Determinations and Findings. In accordance with the provisions of Sections 12 -17 and 12 -18, Hawai`i County Code 1983 (2005 Edition, as amended), the Council hereby determines to proceed with the improvements proposed in Council Resolution 74 -11, and further described in the Manager's Report. The Council finds that the establishment of the proposed Improvement District will be in the public interest and will provide significant benefits to the health, safety and welfare of the residents of the Subdivision, including: a. The installation of underground waterlines, constructed and installed in accordance with Department of Water Supply standards, which will eliminate the need for private catchment systems, alleviate potential leakage problems associated with long overland pipes currently serving a portion of the Subdivision, and provide residents with a reliable water supply and regular water pressure; and b. The installation of fire hydrants in the Subdivision, which will afford a greater measure of public safety and homeowner security in the Subdivision, and may potentially result in lower fire insurance premiums for owners within the Subdivision. 2. Creation, Definition and Establishment of the Extent of the Improvement District. The Council hereby creates, defines, and establishes a Water System Improvement District consisting of all "assessment units" (as such term is defined below) located within the Subdivision, comprised of TMKs 7 -2- 008:1 -41 (excluding lot 39, which is not part of the Subdivision) and TMKs7 -2- 09:1 -42 (excluding lot 41, which is the road lot). The owners of assessment units within the Improvement District are those persons identified in the "Proposed Assessment Roll" attached to this resolution as "Exhibit D." The Council acknowledges that changes in property ownership and the recordation of ownership of assessment units by the County of Hawaii Real Property Tax Division may be subject to change and /or revision prior to 3 the passage of a bond ordinance to finance the Improvement District. At that time, a final Assessment Roll of owners of assessment units within the Improvement District shall be compiled by the Department of Water Supply. 3. Kind, Extent and General Details of the Proposed Improvements. The improvements shall consist of a public water system (the "Water System ") consistent with applicable Department of Water Supply standards, which shall be owned, operated, and maintained by the Department of Water Supply. The construction and installation of the Water System shall include the removal of all existing meters and laterals servicing residents of the Improvement District, and the installation of meters for each currently existing assessment unit within the Improvement District. 4. No Acquisition of Land Required; Required Easements or Other Use and Occupancy Agreements. The construction and installation of the Water System for the Improvement District will not require the acquisition of land. However, an easement over the privately -owned subdivision roads will be required for maintenance and operation of the Water System. In addition, an easement or other agreement to use and occupy an area within the Mamalahoa Highway right -of -way will also be required for a portion of the Water System. 5. Part or Proportion of the Cost of the Improvements to be Borne by the County. The total costs of the design, instruction and installation of the Water System, including the acquisition of the parcels described in the preceding section (collectively, the "Project Costs "), is estimated to be $1,569,369, which is anticipated to be financed by: (a) a grant from the U.S. Department of Agriculture Rural Development ( "Rural Development ") in the amount of $353,369, to be applied against the Project Costs; (b) a 35 -year loan from Rural Development to the County in the amount of $1,169,000, which loan shall be evidenced by a bond of the County (the "Improvement District Bond ") and repaid out of the proceeds of assessments to be assessed to the owners of assessment units within the Improvement District; and (c) an applicant contribution required by Rural Development in the amount of $47,000, which applicant contribution shall be advanced by the Department of Water Supply and repaid out of the proceeds of assessments assessed to the owners of assessment units within the Improvement District. The County of Hawai`i shall bear the customary operating costs of loan management by its Department of Finance - Treasury Division for the 35 -year duration of the Improvement District Bond. These costs will be partially offset by charging a collection fee as specified in Chapter 12, Hawai`i County Code 1983 (2005 Edition, as amended). A prepayment penalty for early payoffs and out -of- pocket transaction costs associated with property transfers will also be assessed. 4 6. Description of the Assessment Unit and Method of Assessment. (a) For purposes of the Improvement District, "Assessment unit" shall mean a duly subdivided parcel of land or condominium unit bearing a unique tax map key number. (b) Each assessment unit existing as of the date that assessments begin to accrue on assessment units within the Improvement District (the "Commencement Date ") shall be subject to an assessment calculated by dividing the Net Project Costs (as defined below) by the number of assessment units within the Improvement District as of the Commencement Date. As used in this Resolution, "Net Project Costs" means the Project Costs, less any grants which reduce the actual costs of the Water System to the County. By way of example, assuming the Project Costs to be $1,569,369, and further assuming a Rural Development grant of $353,369, to be applied against the Project Costs, the Net Project Costs would be $1,216,000. The Council finds that, assuming Net Project Costs of $1,216,000, the anticipated assessment per assessment unit ($1,216,000, divided by 81) will be $15,012.35. 7. Materials to be Used. The materials to be used in the construction and installation of the Water System are set forth in the Manager's Report, which is incorporated herein by reference, and include, without limitation, the following: i. 1,022 linear feet of 8 -inch ductile iron waterline; ii. 3,620 linear feet of 6 -inch ductile iron waterline; iii. Seven fire hydrants; iv. Eleven Type "A" service laterals; v. Thirty -five Type "C" service laterals; vi. One pressure reducing valve station; and vii. Miscellaneous valves and fittings. 8. Direction to the Manager, Department of Water Supply. In accordance with Section 12 -19, Hawai`i County Code 1983 (2005 Edition, as amended), the Manager is directed to prepare a corrected map of the special improvements to be constructed or improved as part of the Water System showing the exact location of the improvements, together with final details, plans and specifications for the work in such form as will readily permit and encourage genuine competition between contractors in the calling of bids and awarding of a contract for the special improvements. 9. Effective Date; Transmittal of Resolution. (3) 7 -2 -09: 1 -42 (excluding Lot 41, which is the Road Lot), all of which lots will constitute "assessment units" within the Improvement District. The special improvements shall include the removal of all existing meters and laterals within the Improvement District, and the installation of water meters for each of the eighty -one (81) assessment units within the Improvement District. The water system improvements will include, but not be limited to: • 1,022 linear feet of 8 -inch ductile iron waterline; • 3,620 linear feet of 6 -inch ductile iron waterline; • Seven fire hydrants; • Eleven Type "A" service laterals; E.Xillf5rr "A" • Thirty -five Type "C" service laterals; • One pressure reducing valve station; and • Miscellaneous valves and fittings. The total estimated cost of the Improvement District is $1,569,369.00. Assuming the project costs to be the Manager's estimate thereof, or $1,569,369.00, and further assuming a U.S.D.A. Rural Utilities Service Grant in the amount of $353,369.00 to be applied against the project costs, the net project costs would be $1,216,000.00. Each assessment unit existing as of the date that assessments begin to accrue on assessment units within the Improvement District (the "Commencement Date ") shall be subject to an assessment calculated by dividing the Net Project Costs by the number of assessment units within the Improvement District as of the Commencement Date. Assuming net project costs of $1,216,000.00, the anticipated assessment per assessment unit will be $15,012.35. The County of Hawai`i shall adopt a general obligation bond and administer the collection of funds from assessed owners to service the debt. Unless paid in full, assessments will be payable in monthly installments sufficient to meet the principal and interest requirements for the County's general obligation bonds issued for the Improvement District until they mature. A property owner's assessment may be paid to the Director of Finance in full, without additional charges, at any time within 30 days after the date of the last publication of the ordinance to set the Improvement District assessments. After this 30 -day period, property owners will also be permitted to prepay the unpaid balance of their assessments in full, plus a 3% premium on the amount to be prepaid (unless waived) and interest at the rate on the bonds until they can be redeemed with the assessment prepayment. 2. Testimony, Protests and Objections At the Public Hearing to be held on June 14, 2011, the testimony of all interested persons and owners of assessment units for or against the establishment of the Improvement District, the extent of the Improvement District, and levy of the special assessment shall be heard. This Public Notice hereby advises all interested parties that, in accordance with 12- 10(e), Hawaii County Code, a protest against making all or part of the proposed improvements or against the methods by which such assessments are to be made, or the inclusion of certain costs therein must be submitted in writing to be considered by the Council. Such written protests or objections may be mailed to: County Clerk, County of Hawai`i, 25 Aupuni Street, Hilo, Hawai`i 96720 prior to the Public Hearing, or such written protest may be submitted in person at the date and time of the Public Hearing. The County Clerk will not accept any mailed protests that are postmarked after June 14, 2011 or protests submitted in person after adjournment of the Public Hearing. This is a public hearing of the Hawai`i County Council in regards to the Ocean View Property Subdivision. Today is June 14, 2011, 6 p.m.— well, actually 6:09 p.m., and we are in the West Hawai`i Civic Center here in Kona. My name is Dominic Yagong. I'm the Chair of the Hawai`i County Council. I would like to welcome all of you. Thank you so much for being here — really appreciate you folks taking your time for being here at our public hearing this evening I'd like to introduce the Members of the Council that are here. First of all, out in Hilo, we do have one Council Member out there — that's Mr. Fresh Onishi. To my far right we have Council Member Fred Blas, Council Member Brenda Ford, and Council Member Pete Hoffmann; to my far left— Council Member Brittany Smart; and to my immediate left, Council Member Angel Pilago. And, again, my name is Dominic Yagong and I will be presiding over today's public hearing. Before I begin to read the agenda here, I do want to thank my colleague to my left, Mr. Angel Pilago —have taken a really a tremendous leadership role in bringing this issue to the County Council. Thank you very much, Sir. Now, the purpose of this public hearing, as required by Chapter 12, Hawaii County Code —in accordance with Section 12 -10, Hawai`i County Code —the purpose of this public hearing is to provide general details of the proposed improvement as adopted by the Council, and to provide the public with an opportunity to examine the resolution, project reports, and other project data. At this meeting, in accordance with Section 12 -17, Hawaii County Code, the Council shall consider any protest, objections, or suggestions to the Improvement District. We just want to remind everybody here tonight that the no Council action will be taken at this hearing. The Council role is to listen to the public. So, we are here. We are not going to be engaged in any discussion from Page 2 the Hawai`i County Council, but we're here to listen not only to the general public, but also listen to the presentation by the Department of Water Supply. Pursuant to Council Resolution 47 -07 and Resolution 40— excuse me— Resolution 74 -11, any statement of protest, objections, or suggestions to the Improvement District must be made by interested persons and/or owners of assessment units in person, at the date and time of the public hearing, is submitted prior to the adjournment of the hearing, and/or in writing, by mail, postmarked no later than June 14, 2011. Just to give you folks an idea —give you guys some information regarding the public notice requirements. They have been fulfilled — newspaper publication in two newspapers, each, on May 25, 2011 and May 27, 2011, June 1 2011 and June 3 2011 —and notarized affidavits and publication received from West Hawai 'i Today and the Hawai`i Tribune - Herald. At this time, I'd like to introduce — introduction of the County department's staff who are on hand to answer questions, to the best of their ability, regarding the project. First of all I'd like to introduce Milton Pavao, the Managing Chief of the Department of Water Supply. We have Kanani Aton and also Ryan Quitoriano —and they're all from the Department of Water Supply. Also, we have Michael Okumoto, the Treasurer of the Department of Finance. We have Kathy Garson from the Corporation Counsel. Kathy Garson is in Hilo. Is that correct Mr. Onishi? Kathy Garson? MR. ONISHI: Yes, that's true. CHR. YAGONG: Okay. Thank you very much. And also here in Kona, we have Nancy Burns, who is a project design engineer. There's Nancy in the audience —thank you. And, also, we have Jamae Kawauchi, the Hawai`i County Clerk to my far left. Now, the Department of Water Supply and the Department of Finance Water Improvement District Overview— that's going to be done by Page 3 Kanani and also Ryan and Michael Okumoto. Questions will be held at the end of the presentation. Oh, excuse me, questions will be held at the end of the public testimony. What we're going to do is we're going to hear the overview from the department, and after that we are going to go into the public testimony. And, if you folks have questions at that time, it's good to state what your question is. We're going to ask the department to keep track of all those questions. And after the public testimony, then we'll bring the department forward to answer those questions that may have been brought up during the public testimony. Okay. MS. FORD: We, the Council, cannot ask questions? CHR. YAGONG: That is correct. MS. FORD: You know this is going to kill me. CHR. YAGONG: Yes. Yes, I know it will be very difficult for you, Ms. Ford, but maybe we can give you a cup of coffee and, hopefully, you'll be happy. Okay. Now, as far as statement of meeting protocol, we request that each member of the public identify themselves by name, address, lot number or tax map key number, and indicate if they are property owner, tenant, or other party. We're recording this public hearing, so that information is very important. We request that each speaker limit their testimony to three minutes —and Mr. Hoffmann will be timing the testimony to allow others to speak. And indicate —if the speaker has a question regarding the Improvement District, the speaker should state the question, and our staff will keep track of all those questions, okay? Reminder — protest must be presented before the close of the public hearing and most -- especially, we want request that everyone treat everyone here with respect and civility so that we have a very nice public hearing. And then after the presentation, of course, we will conduct the public hearing. After that, we are going to recess, which will give our County Clerk an opportunity to tally the number of communication that was received, and she'll give a brief report at the end of the meeting. YAGONG: I need —a little closer to the microphone, Allen —thank you. MR. GOMES: Yes. I'm Richard Allen Gomes. I own the first lot at the very top of the subdivision. The TMK is 7 -2 -08 -038. Is it (inaudible) to many Council Members? I appreciate the opportunity to express my concerns about our Water Improvement Project. One of the deciding factors for my wife and I to purchase property in this subdivision was having a lot at the very top with access to water and utilities. I feel for those who purchase property further down, but they knew what they were facing. I feel that an unfair burden has been placed upon us with this water project. I strongly feel that we should be exempt from the cost of this project, being that the main waterline passes right in front of our property, and we already have water connected. CATHERINE Hi. My name is Catherine Hamilton. I —my address is 72 -1039 Puukala Road. HAMILTON: My TMK is 7- 2 -9 -13. I am in support of the Water Improvement District. And I would like to thank all of the Council and the Water Department for bringing us to this point. And I hope that we will be successful in getting water within the next couple of years. Thank you. CHR. YAGONG: Thank you very for your testimony. Our next testifier will be John Dawrs, to be followed by Kelly Shaw. Aloha. Good evening. JOHN DAWRS: Good afternoon —or good evening. My name is John Dawrs. I believe my street address is 72 -1066, and TMK is 7- 2- 09 -26. I just heard something that I'd like to clarify. For those of us that purchased our lots a long ago, and I purchased my lot in 1980, so it's —and I purchased my lot up there because it was the only place that I could afford. I was a County employee working as a police Page 9 officer, and was rejected being able to have a home in the State housing. They said I didn't make enough money. So, I ended up buying that lot with a shack on it, and lived in that shack for a long period of time with — and back then there was no electricity, no telephone, and no water. There was no water at the top of the hill either. The water that was —they said was along the highway did not come right away —did not come until quite a few years later. And along with that, a water tank on the mauka side of Mamalahoa Highway. Anyway, I am very much in favor of this project. I would like to thank all of the County of Hawai`i personnel who assisted in putting together this Water Improvement Plan for the Puukala Subdivision. I have special thanks to the Department of Water Supply — Milton Pavao and his crew, Ryan the Project Engineer, Mr. Okumoto for figuring out the dollars. I'd also like to thank my neighbors, which are really important because we had tried several times getting water down into this —and we fail every time and Milton can testify to that —that this is not the first attempt. So it's been a long time coming. The neighbors that stuck it out and kept fighting for it are real important —and I thank them for it. I think the promise of the best drinking water in the State of Hawai`i, as Milton says, is real important —which he always says he's going to give us. The other thing is that we are the —when you're on the ocean and you look up the mountain, we're that first subdivision on the north end of Kona. And if there is a fire that comes from the north, it's going to run us over. And without those fire hydrants, we don't stand a chance —and we certainly don't have enough water in our water tanks. I'd also like to thank Councilman Angel Pilago and his staff for the work they've done in helping push this forward. Thank you. CHR. YAGONG: Thank you for your testimony. Kelly. It's something we can easily take it for granted nowadays, but it's definitely a necessity and something that we need every day to just survive or basic needs. So, I'm definitely in support of this. And thank you very much for your time. CHR. YAGONG: Thank you for your testimony. Aloha. CYNTHIA Hi. I'm Cynthia Cabral, and I live at 72 -992 Puukala. My tax is 7 -2 -09 -040, CABRAL: and I am in support of the water. I've been living there for 28 years, and did believe that I was going to have water in the future. I didn't buy the property not thinking I was going to have water. And I'm very thankful for this progress that we've made because we've had a lot of dead -ends, and I really want this to go through. And I thank you very much —and I thank all the ladies that helped put this through. Thank you. CHR. YAGONG: Thank you very much for your testimony. So, what we're going to do is move into the "questions" part of the public hearing. I did hear just one question that did come out during the testimony. However, I will allow people, if you do have any further question —we're going to see if we can get the cordless mic. to bring it forward. But I do believe that you heard the question. I believe it was from the gentlemen that says they already have a water meter —and the question was whether or not they would have to pay up the assessments that was presented. MR. OKUMOTO: Yeah. Thank you, Mr. Chairman. I think the first answer is whether or not to pay the assessment. The assessment — there's rules that covers the Improvement District process, and I think the majority of the residents —obligates 100 percent of the residents —so that's something for the attorneys. But I'm sure they will be obligated to pay. Now, if you have a meter —as I mentioned earlier —you will not have to pay the facility charge `cause you already paid that one time. You will not have to pay the credit deposit because you already paid that one. So, the only thing you would have to pay is the meter installation charge because your meter will now be relocated directly in front of your home. So, the Page 11 meter installation will have to be made. But again, repeating, you will not have to pay the facility charge and you will not have to pay the credit deposit. CHR. YAGONG: Thank you. The gentlemen that asked that question, did you want to follow -up with anything or did that answer your question? That's okay. Okay, Ryan Grace —thank you, Sir. Is there anyone else from the general public that would like to ask a question of the department? Okay, Sir —Lali provide you the microphone. STARSONG: I wonder if there's just such a way that some of the people that are on the road, that already have meters, that they could be eliminated from the count, and prorated the balance of it over the rest of us? I need a meter, but I'm just thinking. Trying to be— CHR. YAGONG: Oh, and, Sir, just for the public record, I need you to state your name —and if you know your lot number, that would be great, too. MR. STARSONG: My name is Daniel Starsong, and my lot number is 7- 2 -08 -008. CHR. YAGONG: Thank you, Sir. Mr. Pavao. MR. PAVAO: Yeah. To do what the gentleman is requesting, we would have to start the whole process again because you would have to carve out that top section. However, the problem with doing that is the State Department of Transportation frowns upon the type of services that is currently alongside of the State Highway, which is one of the reasons we're anxious to do this, again —well, once again, conform with State Department of Transportation. The way the lots are configured, the waterline that will serve these lots that are adjacent to the highway will be with a pipeline within the subdivision. We've had many complaints from State Highways —when are we going to get it up the— right -of -way, so this accomplishes that. But I guess the gentleman's main question is —the process would have to start over again and the boundaries of the Improvement District will have to be redrawn. Page 12 CHR. YAGONG: Okay. Anybody else? (At this time, Mr. Richard Allen Gomes, public member, came forward.) CHR. YAGONG: Again, state your name for the record, please, and if you have your lot number. MR. GOMES: Richard Allen Games. So, actually, just because it has to be redrawn, the project cannot be —I speaking, like, for myself, being right there at the road —being right there at the lateral, and I just stay there. MR. PAVAO: As I mentioned, the State Department of Transportation frowns upon the situations out there. And once this Improvement District goes in, if any meter is left on the sidewalk or the right -of -way, the Department of Transportation will force us to take it off because it's a non - conform and use of their State Highway. MR. GOMES: So, the meters on the right side of me will all have to be removed, too? MR. PAVAO: On the right side? MR. GOMES: Well, on the north side. On the Waimea side —all those meters have to be removed? I'm talking about my neighbors —not pertaining with the Puukala Subdivision. MR. PAVAO: Well — MR. GOMES: The neighbors on further down. As it is now, Department of Transportation will not allow us to put the type of meters that we've done in the past years, for example. We could never get a permit to do that again, so those that are there now will remain, though? MR. PAVAO: If they're not part of the Improvement District, not part of this Puukala Improvement District —then they'll remain. CHR. YAGONG: Any other question from the general public? Okay, seeing none —Madam Clerk, did you need a recess for you to calculate the information? You need a short recess? Okay. So what we're going to do is take a very short recess, and when the Clerk is ready, she'll bring the information and communications to the Council. Short recess. As a resident of the subdivision it has been a goal of ours for a while. I am sure all of you have heard all the valid reasons why we have the need for county water. I knew that Pu'ukala subdivision was on a water catchments system when I bought it 20 years ago, but never gave up the dream of having county water. With new development all around us (Makalei, a new fire station, and more) I feel that now is the time to keep up with surroundings. One of the deciding factors for my wife & I to purchase property in this subdivision was having a lot at the very top with access to water & other utilities. I feel for those who purchased property further down, but they knew what they were facing. I feel that an unfair burden has being placed upon us with this water project.
