COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 124 11 <br />RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO EXECUTE <br />GRANT OF EASEMENTS IN FAVOR OF THE STATE OF HAWAII, DEPARTMENT <br />OF AGRICULTURE FOR IRRIGATION PURPOSES <br />WHEREAS, the County of Hawai`i is the owner of certain roadways within the certain <br />parcel of land situated at Waikoloa, Lalamilo and Lihue, Waimea, South Kohala, Island of <br />Hawai`i, Hawai`i, identified by Tax Map Key No. (3) 6 -6 -005; and <br />WHEREAS, the State of Hawai`i, Department of Agriculture requires Grant of <br />Easements over the roadways of the identified parcel for irrigation purposes; and <br />WHEERAS, the requested Grant of Easements is described as Easement IR -1 (for <br />irrigation purposes), more particularly described in Exhibit "A," attached hereto and made a part <br />hereof, Easement IR -2 (for irrigation purposes) more particularly described in Exhibit "B," <br />attached hereto and made a part hereof, and Easement IR -3 (for irrigation purposes) more <br />particularly described in Exhibit "C," attached hereto and made a part hereof, and delineated on <br />Exhibit "D" attached hereto and made a part hereof; and <br />WHEREAS, Section 2 -111 of the Hawai`i County Code states that the Finance Director <br />may be authorized by resolution of the County Council to grant an easement for a particular <br />purpose, subject to a reverter back to the County upon termination or abandonment of the <br />specific purpose. <br />WHEREAS, Section 2 -120 of the Hawai`i County Code allows a disposition of real <br />property to government and government agencies without the appraisal, auction and other <br />requirements in article 19 of the Hawai`i County Code. <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that <br />pursuant to Section 2 -120 of the Hawai`i County Code, Nancy Crawford, Finance Director of the <br />County of Hawai`i, is hereby authorized to execute grant of easements in favor of the State of <br />Hawai`i, Department of Agriculture, for irrigation purposes over and across the roadways within <br />Tax Map Key No. (3) 6 -6 -005. <br />
