HomeMy WebLinkAboutRES 124 Draft 01 2010-2012COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 124 11 RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO EXECUTE GRANT OF EASEMENTS IN FAVOR OF THE STATE OF HAWAII, DEPARTMENT OF AGRICULTURE FOR IRRIGATION PURPOSES WHEREAS, the County of Hawai`i is the owner of certain roadways within the certain parcel of land situated at Waikoloa, Lalamilo and Lihue, Waimea, South Kohala, Island of Hawai`i, Hawai`i, identified by Tax Map Key No. (3) 6 -6 -005; and WHEREAS, the State of Hawai`i, Department of Agriculture requires Grant of Easements over the roadways of the identified parcel for irrigation purposes; and WHEERAS, the requested Grant of Easements is described as Easement IR -1 (for irrigation purposes), more particularly described in Exhibit "A," attached hereto and made a part hereof, Easement IR -2 (for irrigation purposes) more particularly described in Exhibit "B," attached hereto and made a part hereof, and Easement IR -3 (for irrigation purposes) more particularly described in Exhibit "C," attached hereto and made a part hereof, and delineated on Exhibit "D" attached hereto and made a part hereof; and WHEREAS, Section 2 -111 of the Hawai`i County Code states that the Finance Director may be authorized by resolution of the County Council to grant an easement for a particular purpose, subject to a reverter back to the County upon termination or abandonment of the specific purpose. WHEREAS, Section 2 -120 of the Hawai`i County Code allows a disposition of real property to government and government agencies without the appraisal, auction and other requirements in article 19 of the Hawai`i County Code. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that pursuant to Section 2 -120 of the Hawai`i County Code, Nancy Crawford, Finance Director of the County of Hawai`i, is hereby authorized to execute grant of easements in favor of the State of Hawai`i, Department of Agriculture, for irrigation purposes over and across the roadways within Tax Map Key No. (3) 6 -6 -005. BE IT FINALLY RESOLVED, that the Clerk of the County of Hawai`i transmit copies of this resolution to Nancy Crawford, Finance Director of the County of Hawai`i, Corporation Counsel, Department of Public Works, and to the State of Hawai`i, Department of Agriculture.
