COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. 112 <br />AN ORDINANCE AMENDING CHAPTER 14, GENERAL WELFARE, HAWAII <br />COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br />RESTRICTING TRANSPORTING OF LIVING AXIS DEER INTO THE COUNTY OF <br />HAWAII. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Chapter 14, Hawaii County Code 1983 (2005 Edition, as amended), is amended <br />by adding a new article to be appropriately designated and to read as follows: <br />"Article . Prohibition on Transporting Living Axis Deer into Hawaii County. <br />Section 14-_. Purpose. <br />The purpose of this article is to protect Hawaii Island's native forests, private property, <br />and agriculture industries from damages and adverse impacts that may be caused by Axis Deer. <br />Section 14- — <br />Transporting Living Axis Deer into Hawaii County; unlawful. <br />It shall be unlawful for any person to transport living axis deer into Hawaii County. <br />Section 14-_. Exemptions. <br />The Pana`ewa Rainforest Zoo is exempt from this article. <br />Section 14-_. Penalty. <br />Any person who violates this article shall, upon conviction thereof, be guilty of a <br />misdemeanor and be sentenced to a fine of up to $2,000, or imprisonment for a period of up to <br />one year, or both." <br />SECTION 2. Severability. If any provision of this ordinance or the application thereof <br />to any person or circumstance is held invalid, such invalidity shall not affect other provisions or <br />
