The Windward Planning Commission, at its duly held public hearing on August 4, 2011, considered the
Planning Director's request for amendments to the Puna Community Development Plan (Puna CDP)
relating to non - substantive language, spelling, and formatting of certain sections of the Puna CDP and the
identification of boundaries for regional town centers, community village centers and neighborhood
village centers.
The Commission voted to forward a favorable recommendation to the County Council on this request.
The draft bills are attached for your favorable consideration. We have also enclosed a copy of the
Planning Director's letter dated May 27, 2011, to the Windward Planning Commission, as well as a
transcript of the hearing for your information.

Bill 194 was introduced by the County Council to initiate amendments to the Puna
Community Development Plan ( "CDP ") and was adopted by Ordinance No. 10 -104 by
the County Council in September 2010. At the time Bill 194 was being considered, the
Puna CDP Action Committee (PCDP AC) recommended several additional amendments,
some of which 1 agreed with. Noted in my May 11, 2010 recommendation letter to the
Windward Planning Commission, these amendments would be introduced after Bill 194
had either been adopted or rejected.
Of the six (6) additional amendments recommended by the PCDP AC, five (5) were
substantive amendments that could not be considered within the context of Bill 194. The
sixth amendment recommended by the PCDP AC proposed some additional non -
substantive formatting and clerical amendments to those included in Bill 194. These
additional formatting and clerical amendments were not adopted by the County Council
due to some confusion with respect to the non - substantive amendments provided in Bill
194.
The Windward Planning Commission voted on a motion to send a favorable
recommendation on Bill 194 to the County Council at its June 4, 2010 public hearing,

with two votes in favor and two votes against. By Rule 2 -28.1 (Community
Development Plan), Hawaii County Code, the Windward Planning Commission's non-
action constituted an unfavorable recommendation on the Bill 194. However, Bill 194
was passed by a 7 -2 vote of the Hawai`i County Council and signed into law by Mayor
Kenoi on November 4, 2010.
Subsequent to the adoption of Ordinance No. 10 -104 (Bill 194), the Planning Director
initiated four (4) of the six (6) additional amendments recommended by the PCDP AC,
which were considered by the Windward Planning Commission at its February 3, 2011
meeting. The Commission issued a favorable recommendation for three (3) of those
amendments following the withdrawal of the fourth proposed amendment due to
overwhelming public testimony in opposition.
On May 17, 2011, the Hawaii County Council approved the initial three (3) additional
amendments to the Puna CDP initiated by the Planning Director and recommended by the
Puna CDP Action Committee.
Now that those initial three (3) additional amendments have been adopted, these final two
(2) additional amendments recommended by the PCDP AC can be introduced for
consideration and recommendation by the Windward Planning Commission and action by
the Hawaii County Council.
PLANNING DIRECTOR'S RECOMMENDATIONS ON ADDITIONAL
AMENDMENTS RECOMMENDED BY THE PUNA CDP ACTION
COMMITTEE
By letter dated April 16, 2010, the Director received the recommendations of the PCDP
AC. Of the six additional amendments recommended by the PCDP AC that I agreed to
introduce for adoption, the remaining two include one (1) substantive amendment and
one (1) non - substantive amendment containing formatting, spelling and grammar
changes, which are being presented by this petition as follows:
1. Amendment proposed by PCDP AC by adding the word "Preliminary" to the
boundary title in the map legends for the Regional Town Centers, Community
Village Centers and Neighborhood Village Centers in Figures 5 -1 through 5 -11
inclusive.
The legends in the original version of these maps as adopted in November 2008
included the word "Preliminary" in the description of each village center

boundary. However, the amendments contained in Bill 194 included the removal
of the word "Preliminary" from the village center boundary symbol's description.
This incorrectly suggests that the boundaries shown on the maps in Figures 5 -1
through 5 -11 are fixed. While this interpretation is clearly incorrect and
inconsistent with the language in Sec. 5.2.2 Criteria for Proposed Locations and
Boundaries to wit:
"The maps toward the end of this chapter indicate the suggested locations
for the village centers in greater detail, based on the following criteria:... "
and
"The maps shown in this chapter are not meant to be precise or strictly
interpreted, but rather as guidelines in the preparation of rezoning requests for
areas within or adjacent to regional town centers, community village centers, or
neighborhood village centers." (Emphasis added)
The Planning Director agrees with the proposed amendment labeled Exhibit 1
attached hereto.
2. Amendment proposed by PCDP AC to amend the language in several areas of
the CDP, correct spelling errors throughout the CDP and to alter the formatting in
certain locations of the CDP.
All of the proposed language changes consist of the simple rephrasing the existing
language to provide greater clarity or adding language for the same purpose that
does not alter the meaning, force or intent of the original language. In one
instance (Sec. 4.2.2e of the PCDP) the entire Item e is being deleted since it
repeats Sec. 4.2.3b.3). (See Section 11 of Exhibit 2)
Review by staff support for the Puna CDP discovered numerous additional
spelling and punctuation errors in both the originally adopted version of the Puna
CDP and the Bill 194 amending version. Most of these errors appear to have been
typographical in nature or having to do with the correct spelling of Hawaiian
words and names.
The extensive use of bullets in the Puna CDP makes accurate referencing to
specific goals, objectives and actions articulated in the CDP difficult. Therefore,

those areas where individual goals, objectives and actions were listed as generic
style bullet items are converted to specific bullet notation, both in the body of the
CDP and within the Implementation Table. Also, the bullet listings within the
body of the text and corresponding Implementation Table were adjusted so as to
be consistent with bullet notations.
The Planning Director agrees with the proposed amendment labeled Exhibit 2
attached hereto.

SECTION 3. Severability. If any provision of this ordinance or the application thereof
to any person or circumstance is held invalid, such invalidity does not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are to be severable.
SECTION 4. This ordinance shall take effect upon its approval.

BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Chapter 2, section 2.1 (Historical, Cultural, and Scenic Resources),
subsection 2.1.3 (Actions), of the Puna Community Development Plan (as amended), is amended
by amending paragraph (a) to read as follows:
"a. Propose Special Design Districts with detailed planning, design standards and review
procedures for the following areas:
[ -] 1) Volcano Village historic core and the separate Biosphere Reserve Buffer Zone (see
Section [tea]_ 2.2.3a);
[ -] 2) Pahoa Town;
[ -] j Kea'au Town; and
[ -] 4) Kurtistown -to- Mountain View corridor:
Refer to Chapter S for implementation guidelines related to this action."
SECTION 2. Chapter 2, section 2.2 (Native Forests and Geological Features),
subsection 2.2.3 (Actions), of the Puna Community Development Plan (as amended), is amended
by amending paragraph (a) to read as follows:
"a. Enact a BRBZ, either separately or as an overlay district for the Volcano area, to include
proposing the following provisions and other supporting measures:
[ -] 11 Standards for maximum land disturbance within the BRBZ;
[ -] 2) A system to monitor the `Ohi`a forest canopy [with] within the BRBZ;
[ -13) A set of economic incentives designed to reduce forest clearance and the number of
developable lots within the BRBZ;
[-1 4) Mitigation standards and procedures that provide guidelines for the restoration and
re- planting of disturbed areas;
[ -] 5.1 A study to mitigate localized flooding in ecologically friendly ways, such as using
vacant, forested lots to absorb floodwaters (see also Action c. in Section 2.3.3);
[ -] ) Use of "small- footprint" septic tanks to reduce lot grading;
[ -] 7.1 An expert advisory committee to assist in developing standards, project reviews and
public education programs related to the BRBZ;
[-1n Designation of unencumbered State -owned lands near Wright Road for either
Natural Area Reserve or Forest Reserve status;
[ -] 9) Amendment to the General Plan to recognize the purpose and intent of the BRBZ
and designation of State -owned lands in the BRBZ to "Open ";
[ -) n)Prohibition of `Ohana Dwelling Units within the BRBZ; and
[-1 11)Within the Volcano area, propose re- zoning agricultural- and residential -zoned lots
to an appropriate designation to prevent further subdivision.
Refer to Chapter S for implementation guidelines related to this action."
SECTION 3. Chapter 2, section 2.2 (Native Forests and Geological Features),
subsection 2.2.3 (Actions), of the Puna Community Development Plan (as amended), is amended
by amending paragraph (c) to read as follows:
"c. Propose to establish an Office of County Ecologist within the Planning Department to
administer the new regulatory provisions and foster partnerships to provide public
education and technical support for forest conservation, such as:
[ -] ) Assisting other County agencies such as Department of Public Works and
Department of Parks and Recreation in their programs and facility planning and
maintenance as they relate to native species habitat preservation;
[ -] 2) Engaging in collaborative relationships with Federal and State agencies, educational
institutions and non -profit organizations that conduct research or administer
programs for the protection of native species habitat and the abatement of invasive
species; and
[ -] ) Launching and sustaining a public education and outreach program to enlist
community support and involvement in forest protection and to raise awareness of
invasive species and practices that threaten the native forest."
SECTION 4. Chapter 2, section 2.3 (Aquifers, Coastal Waters and Stormwater),
subsection 2.3.1 (Goals), of the Puna Community Development Plan (as amended), is amended
by amending paragraph (b) to read as follows:
"b. [ ] Maintain and increase [thei*] the quality[ -] of coastal waters."
SECTION 5. Chapter 3, section 3.1 (Land Use Pattern), of the Puna Community
Development Plan (as amended), is amended by amending the 6th sentence in the lst paragraph
to read as follows:
"Community village center are projected for Volcano, Mountain View,
Kurtistown, Hawaiian Paradise Park, Maku`u, and 'Ainaloa."

SECTION 6. Chapter 3, section 3.1 (Land Use Pattern), subsection 3.1.3 (Actions), of
the Puna Community Development Plan (as amended), is amended by amending paragraphs (a)
through (d) to read as follows:
"a. Provide County support for land use entitlements and land assembly for village center
formation and voluntary land pooling projects by:

Initiating a special use permit request or petition for a land use district boundary
amendment for uses that would require such designations under State law;
Seeking an amendment to the State Land Use Law (Chapter 205, Hawai`i Revised
Statutes) that would enable the adoption of special "rural town/village" standards
for locations meeting certain criteria in the State Agriculture District or State
Rural District, subject to a review and approval process that is simpler than the
present method of boundary amendment;
Seeking State enabling legislation to allow County retention of lots that are in
foreclosure for delinquent real property tax payments rather than having them
auctioned for sale to the highest bidder, so that they can be used for relocation
purposes when other properties are acquired for future rights -of -way, public
facilities, land assembly related to village /town center development, or other
objectives of the community development plan; and
Extending technical assistance and advice to a community -based land pooling
association concerning legal and financial aspects of land pooling as they relate to
County or State legal requirements and tax policies.
b. Establish the following general classifications and locations for village and town centers
in Puna:
Kea'au, Pahoa, and Hawaiian Paradise Park shall serve as Regional Town Centers
to provide a wide range of services for the Puna district;
[ -1) Community Village Centers shall provide a more limited range of services in
smaller existing urban settlements and in large subdivisions that are experiencing
the greatest rates of build -out; namely, at 'Ainaloa, Kurtistown, Maku`u
Homesteads, Mountain View, two or more locations in Hawaiian Paradise Park,
and at Volcano; and
[1.1) Neighborhood Village Centers shall be the smallest in scale and located in
underserved remote communities and in subdivisions with relatively small lot
sizes and significant rates of population growth.
Refer to Chapter S for more detailed implementation guidelines on this proposed action.
c. Facilitate land use entitlements and other tools for the development of existing and future
village /town centers and special design districts by:
[-1 1) Recommending approval of applications for commercial zoning or use permits
for existing commercial uses in designated village /town centers that do not
presently have appropriate entitlements, and for proposed uses at appropriate
nearby locations, provided that the size and use of the expansion area conforms to
the criteria applicable to the type of village /town center at that location; and

[ -] 2.) Recommending denial of applications for zone changes for commercial or light
industrial use on sites that are not within designated village/town centers.

SECTION 8. Chapter 3, section 3.6 (Energy Sustainability), subsection 3.6.3 (Actions),
of the Puna Community Development Plan (as amended), is amended by amending paragraph (f)
to read as follows:
"f. Apply the Public Utilities Commission Public Benefits Fund [te] as incentives to
homeowners and landlords to retrofit dwellings for alternative energy devices and
systems, using a sliding scale to provide greater subsidies to low - income households.
The County may augment this with matching grants and low- interest loans."
SECTION 9. Chapter 3, section 3.6 (Energy Sustainability), subsection 3.6.3 (Actions),
of the Puna Community Development Plan (as amended), is amended by amending paragraph (i)
to read as follows:
"i. Pursue the development of new renewable energy sources such as Ocean Thermal Energy
Conversion (OTEC), wave - energy generation and solar energy capture as the technology
advances to make an investment in such a demonstration and production facility in Puna
feasible.

To facilitate this, pursue an ocean energy subzone or enterprise zone designation
for a section of coastal land in Puna, preferably on State land, in order to
encourage research and production of ocean-based alternative energy systems and
facilities.
In addition to energy generation, cold water aquaculture and agricultural
processing should be encouraged and accommodated, including refrigerated
warehouse and processing facilities, hot -water treatment of agricultural products,
and agricultural product washing and packing facilities."
SECTION 10. Chapter 4, section 4.2 (Mass Transit), subsection 4.2.2 (Objectives), of
the Puna Community Development Plan (as amended), is amended by amending paragraph (c) to
read as follows:
"c. Provide park-and:ride lots at key regional sites to promote commuter ridership."
SECTION 11. Chapter 4, section 4.2 (Mass Transit), subsection 4.2.3 (Actions), of the
Puna Community Development Plan (as amended), is amended by amending paragraphs (b)
through (1) to read as follows:
"b. Improve transit service operations by:
[ -] 11 Increasing transit service to a minimum of two additional runs during peak hours;
[ -] ) Establishing demand responsive transit in subdivisions;

[ -] 3) Providing commuter express bus service from Pahoa to Hilo and Volcano to
Hilo[i] with local bus or paratransit services to feed selected stops in order to
provide service to a broader area and
[ -] 4) Establishing 'a hub - and -spoke transit system, in which transit circulators are
teamed with trunk routes on major highways.
c. Develop transit hubs at the following locations:

Kea'au (Primary Hub): In -town location near commercial centers or on State
lands adjacent to the soccer fields; second site could include a new Mass Transit
Agency (MTA) baseyard and headquarters;
Pahoa (Secondary Hub): On County -owned sites, either adjacent to Pahoa
Community Center or on Highway 130 near Kahakai Boulevard where the new
fire and police stations are planned;
Volcano (Secondary Hub): Either at Cooper Center or on other available land; and
bus:
f-] e. Develop a cooperative program with the Department of Education and private schools to
provide student passes for the Hele -On Bus.
[g] f. Launch a public education campaign promoting transit services, tailoring them to target
populations such as youth, commuters, and the elderly.
[h] g. Cultivate public /private partnerships, such as employer- sponsored bus passes.
[1] h. Expand the staff of the Mass Transit Agency to provide greater support for public
relations, route planning and coordination, technical operations and fleet management.
(] i. Investigate other incentives to increase ridership, such as continuance of free fare
program, convenient bus ticketing systems, reduced monthly rates for residents and
special needs populations, adding airport and post office service and tourist passes.
[k] j. Work with Hawaii Department of Transportation (DOT) in creating safe pedestrian
conditions for using mass transit.
[1] k. Expand Hele -On transit service to include regular service to both the Hilo and Keahole
International Airports from all existing and future service routes.
SECTION 12. Chapter 4, section 4.3 (Roadway Network), subsection 4.3.3 (Actions),
of the Puna Community Development Plan (as amended), is amended to read as follows:
"4.3.3 Actions
a. Short Term (2008 -2012)

Plan and design the PMAR alignment through an environmental impact statement
process that meets Federal Highway Administration (FHWA) standards and
therefore qualifies the project for FHWA funding;
Require building setbacks within HPP lots along the designated PMAR
alignment, as necessary, to reserve the potential for a future PMAR extension
through the remainder of HPP;
Establish emergency routes, using mostly existing road beds;
Include pedestrian and bicycling requirements in all projects; and
Create connectivity alignments between the following subdivisions: Hawaiian
Acres and Fern Acres, Fem Acres and Kopua Farm Lots, Eden Rock and Fern
Forest, Orchidland and Hawaiian Acres, Nanawale and Hawaiian
[Beaehesi]Shores, Hawaiian Beaches and HPP, Kea'au Agricultural Lots and a
site adjacent to Kea`au Elementary School, `Ohi`a Estates and Royal Hawaiian
Estates. These inter- subdivision roads should be staggered, low- impact, and
multi -modal. The general locations are indicated as ovals in Figure 4 -1.
b. Medium Term ([2012] 2013 -2017)

Construct a two -lane PMAR roadway that connects Kaloli Drive between
approximately 16th Avenue and 10th Avenue in HPP to either Highway 11 or
Highway 130 in the vicinity of Kea`au;
Construct a two -lane, unpaved, gated emergency access roadway between
Kahakai Boulevard to HPP which can later be converted into a future extension of
PMAR;
Construct a two -lane roadway between Nanawale and Kahakai Boulevard that can
be used as both an emergency access route and a future extension of PMAR; and
Study the need, desirability and feasibility of adding an alternative route between
Pahoa and Highway 11 and between Highway 11 and Stainback Highway in the
stretch between Glenwood and Kurtistown, as generally depicted on Figure 4 -1.
c. Long Term ([2017] 2018 -2030)

Construct Phase II segments of PMAR, as generally depicted in Figure 4 -1;
Acquire additional right -of -way via land pooling, exchanges, and other means to
extend PMAR through Hawaiian Paradise Park; and
If increased traffic demand indicates, construct the PMAR extension through the
remainder of HPP, as depicted generally in Figure 4.1, and convert the emergency
access route from Kahakai [Drive] Boulevard to HPP as a PMAR extension by
removing the gate and paving the surface."
SECTION 13. Chapter 4, section 4.4 (Highways), subsection 4.4.3 (Actions), of the
Puna Community Development Plan (as amended), is amended to read as follows:
"4.4.3 Actions
All of the following are recommendations to DOT.
a. Short Term (2008- 2012):

Make interim intersection improvements on Highways 11 and 130;
Reduce speed limit on Highway 130 to 45 mph between the Kea'au bypass and
`Ainaloa Boulevard;
Conduct a study to determine the most efficacious way to create greater highway
safety for alI travel modes, including .a cost benefit analysis for each studied
method, and consideration of a wide range of traffic calming features (including
roundabouts), highway widening, the use of frontage roads, and various types of
intersection controls; and
Implement the Shoulder Lane conversion project between the Kea'au Bypass and
Shower Drive/Pohaku Drive as a reversible lane to accommodate AM and PM
peak periods.
b. Medium Term ([2012] 2013 -2017)
Increase capacity on Highway 130 between the Kea'au Bypass road and `Ainaloa
Boulevard, utilizing the results of the study of highway safety alternatives
described above;
Construct [an exit] a right exit lane on Highway 11 below Kea'au Agricultural
Lots to Kea'au Village using the existing Old Volcano Road right -of -way; and
Create a right hand turn lane from Highway 132 onto Highway 130."
SECTION 14. Chapter 4, section 4.5 (Non- Motorized Travel and Scenic .Byways),
subsection 4.5.3 (Actions), of the Puna Community Development Plan (as amended), is amended
by amending paragraphs (e) and (f) to read as follows:
"e. Complete surveys, acquisition of right -of -way, maintenance agreements, planning and
design, and construction for multi- purpose trails, including:
[ -1 fl Old Volcano Trail, extending between points near Volcano and the Puna Railroad
Bikeway;
[ -] 2) Railroad Avenue (portions of which are known as Railroad Right -of -Way),
extending between points near Kapoho and Pana`ewa;
[ -] 3) Old Puna Trail (portions of which are known as Old Government Road or Beach
Road), extending between points near Kapoho and Hilo; and
[ -] 4) All coastal trails.
Trails may also be used as emergency access routes, where appropriate.
f. Improve Highway 137 (Red Road) as a scenic corridor' by:
[ -] I) Requiring a 15 -foot easement along the frontage of private properties along the
corridor within which native and mature trees of non - invasive species must be
retained, unless they are in poor health due to natural conditions, not due to
malicious acts, and/or pose a threat to public health and safety;
[ -12) Preserving Mango, Kamani, and Monkeypod groves and tree tunnels;
HI) Providing property tax relief to owners who maintain the easement in the manner
intended and State tax credits to those who replant easements with non - invasive
plant material approved by the County;

[ -] 4) Adding interpretive markers and small visitor parking areas at historical sites,
such as the two Kehena sites listed in the General Plan;
[ -] ) Providing pullouts along the highway at intervals so that travelers can stop to
enjoy the scenery without conflict with traffic in travel lanes;
[ -] ) Delineating and maintaining physical access to the shoreline at appropriate
locations on the makai side of the road;
[ -] 7) Minimizing tree pruning by using special, shielded cable for overhead utility lines
or by undergrounding sections of the line;
[ -] 8) Minimizing excessive lighting by limiting street lights to major intersections and
informing residents along the corridor about how to reduce illumination of
driveways;
[ -] 9) Develop at least one scenic turnout near Kehena Beach that includes restroom
facilities and an emergency phone;
[ -] 10) Creating a simple walking trail on the Lava and new parking area with restrooms
on the State owned accretion land at the new Kaimu Beach;
[ -] 11) Posting warning signs, where appropriate, in newly realigned sections; and
[ -] 12) Covering old section of road with cinder soil to allow Naupaka to reclaim the
land."

PUNA COMMUNITY DEVELOPMENT PLAN IDENTIFYING BOUNDARIES FOR REGIONAL,
COMMUNITY VILLAGE AND NEIGHBORHOOD VILLAGE CENTERS was called to order at 12:24 p.m.
in the County of Hawai`i, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawai`i, with Chairman
Zendo Kern presiding.
COMMISSIONERS PRESENT: Zendo Kern, Dean Au, Wallace Ishibashi, and Raylene Moses
STAFF PRESENT: Julie Mecklenburg (Deputy Corporation Counsel), B. J. Leithead Todd (Planning Director),
Daryn Arai (Planning Program Manager), Phyllis Fujimoto (Staff Planner), Maija Cottle (Staff Planner) and Jeff

KERN: Planning Director initiated Ordinance amending the Puna Community Development Plan, as adopted
by Ordinance No. 08 -116 and amended by Ordinance Nos. 10 -104, 11 -51, 11 -52 & 11 -53 relating to the

ARAI: Madam Director? I'm not sure if she was going to provide just a brief summary of the proposal.
LEITHEAD TODD: No.
ARAI: Nothing. I guess it speaks for itself. You do have two communications that were provided to you by the
Planning Department. And we do have staff available in case there are any specific questions regarding these
requested amendments.
KERN: So since there is no applicant, we don't need to do that. There's nobody signed up from the public to
testify.
SIRACUSA: I did.
KERN: I don't see your name. It doesn't mean we can't make it happen.
SIRACUS: Sharon, I gave it to Sharon.

SIRACUSA: I do.
KERN: Very good. Name and district you represent.
SIRACUSA: My name is Rene' Siracusa and I live on South Road, Kaohe Homesteads, just outside of Pahoa.
The last time I saw you, I was up there and you were testifying; and that was for the Puna Community
Development Plan; and here we are, Puna Community Development Plan.
I was hoping that staff would do a presentation so 1 could be a little more clearer about what I was testifying
about. I only can say what Bobby Jean presented to the Puna Community Development Plan Action Committee
a couple of weeks ago. And one of the things she mentioned is that she is proposing to amend the boundaries to
the Pahoa Village Center Map and designation by, first of all, moving all the potential for commercial zoning
from makai of Highway 130 to the Pahoa Village area. I hope I'm testifying about the right thing, Bobby.
LEITHEAD TODD: No, that's the amendment to the General Plan. And that's not on our agenda because
we're still going to do community meetings on the proposed amendment to the General Plan. This is, I'm sorry,
I guess I should have done a brief overview.
These are amendments to a great extent that were recommended by the Action Committee when we were doing
Bill 194. But because of the timing of stuff we didn't send it in with Bill 194 because that was a separate bill.
So these are some of the recommendations that they had which we said we would then process later. And so
that's what this is. So we're going to add the word "preliminary" back into the legends for the regional town
centers. We're going to do some amendments to correct spelling errors -.
SIRACUSA: But that's No. 11, right?
LEITHEAD TODD: Yeah, and -.
SIRACUSA: That's relating to the nonsubstantive language. And No.10 says relating to identification of the
boundaries.
KERN: Yeah, and so the No. 1 here, it's amendment proposed to CDP AC by adding the word "Preliminary" to
the boundary title and the map legends of the regional centers, community village centers and neighborhood
village centers. That's pretty much the extent of this amendment
SIRACUSA: Then I have nothing to testify about.
LEITHEAD TODD: Okay, all right. And it was what the Action Committee had asked for.
SIRACUSA: Well, I support what the Action Committee asked for cause that's the whole idea of an action
committee. So thank you very much for your clarification.

KERN: Thanks for coming up. All good. Thank you. So seeing here there is no one else signed up from the
public to testify. And we can entertain a motion.
AU: Mr. Chair?

AU: I move for Communication No. 10 to send a favorable recommendation to the County Council for
Ordinance No. 08 -116.

KERN: Any discussion? I will say that this makes a lot sense on my side of things. It gives a little more
flexibility and works with some of the community associations that are peeved about being put into a box where
their stuff can be; and I think it gives the flexibility that Puna needs to allow things to work. So I'm done with
