COUNTY OF HAWAII <br />STATE OF HAWAII <br />BILL NO. 126 <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 14, GENERAL WELFARE, HAWAII <br />COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO AXIS DEER <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Purpose. Axis deer directly compete with cattle and other live stock for <br />food. They eat cash crops and native vegetation, and if unregulated, could devastate the Big <br />Island agricultural industry. This ordinance is a preemptive attempt to quell the negative effect <br />that axis deer have in our county by prohibiting the transportation and harboring of axis deer. <br />This ordinance will take effect ninety days after its approval. <br />SECTION 2. Chapter 14, Hawai`i County. Code 1983 (2005 Edition, as amended), is <br />amended by adding a new article to be appropriately designated and to read as follows: <br />"Article . Regulation of Axis Deer. <br />Section 14 -_. Transporting live axis deer into the County; unlawful. <br />It is a violation of this article for any person to transport live axis deer into the County. <br />Section 14 -_. Transporting live axis deer within the County; unlawful. <br />It is a violation of this article for any person to transport live axis deer within the County. <br />Section 14 -_. Harboring axis deer; unlawful. <br />It is violation of this article for a person to give shelter or refuge to axis deer on private <br />property. <br />Section 14 -_. Exemptions. <br />The Pana`ewa Rainforest Zoo is exempt from this article. <br />Section 14 -_. Penalty. <br />Any person who violates this article shall, upon conviction thereof, be guilty of a <br />misdemeanor, and be sentenced to a fine of up to $2,000, or imprisonment for a period of up to <br />one year, or both." <br />
