Pursuant to Hawaii County Code (HCC) Section 3- 22(a), I am forwarding Walmart
Stores, Inc., completed application for a sign variance. The owner of the property is
Walmart R. E. Business Trust and the applicant is Teressa Jones, BRR Architecture,
Inc. whose phone number is (913) 266 -9095. The applicant is requesting a sign
variance for two (2) wall signs. The proposed signs are 147.78 square feet in area with
a 66 -inch symbol. The maximum allowable letter and /or symbol is nine inches per
Section 3 -58 (c), Chapter 3, Hawaii County Code. The business is located in CG -20
zone which limits the wall sign to nine feet in height per Section 3- 59(a)(4), Chapter 3,
Hawaii County Code.

(6) Attachments required to be filed with this application:
(a) A complete copy of any sign permit application or rejection of the sign permit, if any;
(b) A photo or drawing of the relevant sign(s);
(c) A map showing the location of the sign(s) and showing all streets adjacent to the building
or lot where the sign is located;
(d) A list of the names, addresses, and tax map keys of all property owners located within
300 feet of the perimeter boundary of the affected property.
(7) Filings Fees: This application must be accompanied by a fee of $100 for each sign or an amount
equal to 10% of the total value of the sign(s), excluding installation costs, whichever is greater,
payable to the County Director of Finance.
(8) Applicant must provide written explanations for the following (please attach sheets):
(a) Granting the variance is necessitated by the peculiar physical conditions not ordinarily
found in most districts, because of the peculiarity of a business, or as a result of a special
event or circumstance;
(b) Granting the variance will not adversely affect the rights of adjacent property owners or
tenants;
(c) Granting the variance will not unreasonably violate the interest, safety, convenience, or
general welfare of the public;
(d) A strict application of the terms of this chapter would work unnecessary hardship and
practical difficulty upon the applicant or community;
(e) Granting the variance will not constitute a grant of personal or special privilege
inconsistent with the limitations upon other properties under identical ordinances, statutes
or rules.

Re: Walmart Sign Code Variance Application
Dear David,
The below are written explanations of the need for variance from the County Code as it
pertains to signage and as required as part of the variance application process.
(a) Granting the variance is necessitated by the peculiar physical conditions not
ordinarily found in most districts, because of the peculiarity of a business, or
as a result of a special event or circumstance;
Variance from the strict application of Article 2 Kailua Village Sign
Provisions as they pertain to sign area (22 sq. ft.), mounting height
(9 feet) and letter height (9 inches) is necessitated by the vertical
relief of the site and the setback from the roadways. The visibility
of the Walmart store and thus signing area is greatly reduced due
to the difference in grade from the adjacent roadways. Only
selective and limited vantage points offer visibility of the two (2)
I.D. signs and from no one (1) point can you view both signs. Along
the west facade, adjacent to Queen Kaahumanu Highway, the top
of the building wall is approximately 65 feet above the roadway
with much of the wall obscured by the tiered retaining wall and
mature vegetation. From Henry Street, the I.D. sign above the
store entry is visible only from the intersection serving the store.
The distance from the intersection to the south facing facade is
approximately 600 linear feet. To adequately sign the store to
passing motorists, and as a matter of public convenience, these
signs need to be of an area, letter height and mounting height to
be visible from the public ways. Our proposal as seen in the sign
detail drawings reflects these needs.
(b) Granting the variance will not adversely affect the rights of adjacent property
owners or tenants;
- As the signs are only visible from certain vantage points, and as the
intensity of lighting is being reduced from the current state, any

potential adverse impacts are minimized. Furthermore, although
not in accordance with the letter of Article 2 pertaining to signs in
Kailua Village, the proposed signs meet the general standards
pertaining to signs in commercial districts in Article 1 of the sign
code. These signs would not adversely affect the rights of adjacent
property owners any more than other commercial signs throughout
Kailua Kona.
(c) Granting the variance will not unreasonably violate the interest, safety,
convenience, or general welfare of the public;
- Granting the variance from the square footage limitation, sign
mounting height and letter height of Article 2 will only add to the
interest, safety and general welfare of the public and consumers as
opposed to the strict application of Article 2. The public interest is
served by adequately and efficiently directing shoppers to the retail
store from surrounding properties and roadways reducing the need
for turnarounds, additional traffic movements and potential
conflicts.
(d) A strict application of the terms of this chapter would work unnecessary
hardship and practical difficulty upon the applicant or community;
- The strict application of Article 2 would indeed result in
unnecessary hardship for the retailer as well as the general public
as signing would be inadequate, not visible from the public right -of-
way and unable to communicate goods and service offered on -site.
The results of which would be potential traffic conflicts, inefficient
traffic patterns and lost revenue.
(e) Granting the variance will not constitute a grant of personal or special privilege
inconsistent with the limitations upon other properties under identical
ordinances, statutes or rules.
- Granting these variances will allow the property owner the same
general privileges enjoyed by other retailers and commercial uses
in the County. Other Kailua Village uses are highly visible from the
public rights -of -way and are of a scale and setback appropriate for
restricted signage. Furthermore, various parties have indicated that
the de facto village boundaries are considered to be non - inclusive
of the subject property and those properties immediately adjacent.
