No. 449/Bill No. 136, reports as <br /> follows: <br /> Bill No. 136, transmitted by Mayor William P. Kenoi, via Communication No. 449, dated <br /> October 20, 2011, is an Ordinance amending section 25-8-30 (Na`alehu Zone Map), Article 8, <br /> Chapter 25 (Zoning Code) of the Hawai`i County Code 1983 (2005 Edition), by changing the <br /> district classification from Single-Family Residential— 15,000 square feet (RS-15)to Village <br /> Commercial— 10,000 square feet (CV-10) at Kawala, Ka`u, Hawaii, covered by Tax Map Key: <br /> 9-5-025:033. Also enclosed was a favorable recommendation from the Windward Planning <br /> Commission Chair Zendo Kern. <br /> Mr. Jeffrey Melrose was present at the Hilo Council Chambers on behalf of the applicant, <br /> Dr. Kevin Stuef. He stated that Dr. Stuef is the only dentist in Ka`u with 1,200 clients and has <br /> been in business for 30 years. He further stated that Dr. Stuef has been renting a location but <br /> wishes to continue to serve the community from the historic house he purchased and is currently <br /> renovating. <br /> Ms. Smart stated that during the drafting of Resolution 60-11, which temporarily delayed council <br /> action on general plan amendments and rezoning applications in the district of Ka`u until the <br /> Ka`u Community Development Plan (KCDP) is adopted or until December 31, 2012, whichever <br /> shall occur first, Dr. Stuef expressed concerns regarding his application in progress. She further <br /> stated that Resolution 60-11 was amended to exclude applications in progress prior to the <br /> resolution's adoption date and asked the Council to support this bill. She added that Dr. Stuef <br /> wants to expand his business and hire additional staff, and there is no need to delay this project <br /> in her district of Ka`u . <br /> Chair Hoffmann stated he would be voting against this bill only because it contains a Fair Share <br /> clause. <br /> PC Rept.
