The current economic downturn has caused a substantial increase in the number of families and individuals seeking food assistance, and the demand for food has caused an acute shortfall in food supplies at the Food Basket’s two warehouses. Re: Comm. 499 Intr. by: Mr. Hoffmann Waived: FC Res. 201-11: AMENDS RESOLUTION NO. 34-11 AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF A MULTI-FISCAL YEAR AGREEMENT FOR FURNISHING AND IMPLEMENTING ORGANIC WASTE DIVERSION SITES AND COMPOST OPERATIONS IN WEST HAWAI‘I AND EAST HAWAI‘I FOR THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT Amends Resolution 34-11 by deleting the following recitals: 1) “estimated at between $1,500,000 and $2,000,000”; and 2) “at an estimated price per ton not to exceed an annual average of $70”. Page 3 Hawai‘i County Council-33 December 21, 2011 Res. 202-11: AUTHORIZES THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR CONTRACT FOR SERVICES OF HAULING OF RECYCLABLE MATERIALS AT ISLAND-WIDE SOLID WASTE RECYCLE AND TRANSFER STATIONS Authorizes the Mayor to enter into a three-year contract with two twelve-month option periods to extend services for hauling of recyclable materials from island-wide solid waste recycle and transfer stations. States that the contract shall be bid with a minimum of two geographic zones for the 21 transfer stations to maximize competition and assures all communities be provided access to the 2-Bin recycling services. The RFP includes, but not be limited to, terms and conditions requiring a private, for-profit entity to lease County buildings and land, requiring payment of royalties for recycled materials, and sharing of any other revenues for the facility. ( ) Banyan Drive, east (makai) side, from a point six hundred seventy-three feet north of Banyan Way and extending thirty seven feet in the northerly direction.” The amendments are necessary as part of the Parks and Recreation’s Reed’s Bay Beach Park Redevelopment and Improvements project. Appropriates excess revenues to the Capital Projects Fund in order for the Public Works Department to expend it. Funds would be used to address parking problems at various locations on the island (including schools, parks and beach access points) and to conduct studies for solutions to these problems. Re-appropriates lapsed fuel tax funds from past fiscal years. States the Environmental Management Director shall administer this article including providing education and enforcement, and shall adopt administrative rules including defining permissible bags and establishing penalties pursuant to Hawai‘i Revised Statutes, Chapter 91, within 180 days from the effective date of this ordinance. Page 9 Hawai‘i County Council-33 December 21, 2011 Bill 128 (Draft 2): INITIATES A CHARTER AMENDMENT TO ARTICLE X, FINANCIAL PROCEDURES, OF THE HAWAI‘I COUNTY CHARTER (2010 EDITION), BY ADDING A NEW SECTION FOR A PUBLIC ACCESS, OPEN SPACE, AND NATURAL RESOURCES PRESERVATION MAINTENANCE FUND Adds a new section, “Public Access, Open Space, and Natural Resources Preservation Maintenance Fund” for the purpose of accruing and using the moneys for maintenance of lands and easements acquired by the Public Access, Open Space, and Natural Resources Preservation Fund. The maintenance fund will preserve the land, promote public safety, and maintain a healthy stewardship. The policies and procedures are set forth in this measure. Re: Comm. 447 Intr. by: Mr. Blas First Reading: December 7, 2011 Bill 139 (Draft 2) REPEALS CHAPTER 26 OF THE HAWAI‘I COUNTY CODE 1983 (2005 EDITION, AS AMENDED), TO BE REPLACED BY A NEW CHAPTER 26, RELATING TO FIRE On January 1, 2010, the State Legislature and the State Fire Council, with approval from the Governor, adopted the 2006 NEPA 1 (Uniform Fire Code) as the Hawai‘i State Fire Code. The State Fire Council has since amended this new State Fire Code, known as Title 12, Chapter 45.2, Department of Labor and Industrial Relations, which became effective at the same time as the State Fire Code. The State Fire Code, with State and respective County amendments, will be the referenced Fire Code. Re: Comm. 454.4 Intr. by: Mr. Onishi First Reading: December 7, 2011 Page 10 Hawai‘i County Council-33 December 21, 2011 Bill 141 (Draft 2): AMENDS ORDINANCE NO. 11-60, AS AMENDED, RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR THE FISCAL YEAR JULY 1, 2011 TO JUNE 30, 2012 Adds the following: Public Works: Tsunami Damage Projects – Federal Emergency Management Agency (FEMA) ($36,000) and Tsunami Damage Projects – County ($315,000); funds shall be provided from Federal Grants Receivable ($36,000) and General Obligation Bonds, Capital Projects Fund – Fund Balance and/or Other Sources ($315,000). FEMA has provided funds to be used for the repair of damages along Ali‘i Drive and other facilities in the Kona area due to a tsunami that was generated from an earthquake off the Pacific coast of Japan. FEMA normally covers 75% of the cost with the balance provided by County matching funds; however, in this case, portions of the project are ineligible to be paid by FEMA and are to be covered by the County.
