not be completed within the next five years. As such, the applicant is also <br />requesting the possibility of an initial administrative extension.. <br />II. PROJECT LOCATION <br />The subject area, consisting of 44.31 acres, is located west or Ka'u -side <br />of the Kea'au -Pahoa Highway (Mile Post 1), approximately one mile south <br />or Puna -side of Kea'au Village. More specifically, it is situated adjacent to <br />and south of the former Puna Sugar Company manager's residence. <br />(Figure 1) <br />III. GENERAL PERMITTING BACKGROUND AND REZONING <br />CONDITIONS <br />As noted earlier, the subject area was rezoned into the County Agricultural <br />(A -1a) district on August 23, 1995. The approval was subject to a number <br />of conditions. This section will initially cover the status of the various <br />conditions of the rezoning ordinance (Exhibit A) and re -state the specific <br />requests. <br />A. The applicant, successors or assigns, shall be responsible for <br />complying with all of the stated conditions of approval. <br />As noted earlier, at the time of the rezoning, the property was owned <br />by Zane Development Group, Inc. The ownership was subsequently <br />transferred to Royal Keaau Holdings, LLC in May of 2003. In 2008, <br />Renaissance Development, LLC, acquired title to the property and is <br />the current owner of record. <br />The new owner intends to assume the responsibility of complying with <br />all pertinent conditions and any amendments thereto of this rezoning <br />ordinance. <br />B. Final Subdivision Approval of the subdivision development shall be <br />secured within five years from the effective date of this change of zone <br />ordinance. As represented by the applicant, the proposed subdivision <br />shall not exceed a maximum of 36 lots (includes the visitor center lot). <br />This is the condition that the applicant is proposing to amend. The <br />proposed visitor center component was abandoned by the previous <br />owner, and the Special Permit for that project was nullified. (Exhibits B <br />and C) A revised tentative subdivision approval for a proposed 37 -lot <br />subdivision (Figure 2) was issued on June 23, 2004 by the Planning <br />Director. (Exhibit F) <br />
