Section 35 -69. Liability. <br />The County shall not be held liable for the installation, maintenance, operation, or <br />management of any publication dispensing device within the district. <br />Section 35 -70. Authorization to Issue and Collect Fines. <br />Any person violating any provision of section 35 -68, any other provision of this article, <br />or any rule adopted pursuant to section 35 -71, shall be subject to a fine of not less than $100 and <br />not more than $500 for each violation. In addition, for any permittee violating any provision of <br />section 35 -68, any other provision of this article, or any rule adopted under section 35 -71, the <br />authorized association may have the permit suspended or revoked, may have some or all of the <br />spaces allocated or reallocated to the permittee deemed abandoned or surrendered, or may be <br />precluded for a time from the allocation or reallocation of publication dispensing rack spaces <br />under this article. <br />Section 35 -71. Rules. <br />The authorized association shall adopt rules for the interpretation, implementation, <br />administration and enforcement of this article, which shall be subject to the approval of the <br />director. <br />Section 35 -72. Fees. <br />All fees and fines collected by the authorized association pursuant to this article or the <br />rules adopted pursuant to section 35 -71 shall be accounted for in the financial records maintained <br />by the district board pursuant to section 35 -19 and shall be deposited into the account established <br />for the district under this chapter. The financial records of the Association including but not <br />limited to all fees and fines collected pursuant to this article shall be subject to review by the <br />County. <br />Section 35 -73. Severability. <br />If any provision of this article or the application thereof to any person or circumstance, is <br />held invalid, the invalidity shall not affect the other provisions or applications of this article <br />which can be given effect without the invalid provision or application, and to this end, the <br />provisions of this article are severable." <br />SECTION 6. Material to be repealed is bracketed and stricken. New material is <br />underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br />underscoring need not be included. <br />SECTION 7. If any provision of this ordinance or the application thereof to any person <br />or circumstance, is held invalid, such invalidity shall not affect other provisions or applications <br />of this ordinance which can be given effect without the invalid provision or application, and to <br />this end, the provisions of this ordinance are declared to be severable. <br />11 <br />
