COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 215 12 <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN <br />AGREEMENT WITH THE STATE DEPARTMENT OF HEALTH FOR A GRANT <br />TO REIMBURSE LOT OWNERS OF HONOKA`A, WHO ARE LOCATED WITHIN <br />A WELLHEAD PROTECTION ZONE AND ARE REQUIRED TO CONNECT TO A <br />SEWER SYSTEM, THEIR SEWER CONNECTION COSTS WHEN APPLYING FOR <br />FINANCIAL ASSISTANCE UNDER THE COUNTY'S SEWER CONNECTION <br />LOAN PROGRAM <br />WHEREAS, the United States Environmental Protection Agency has mandated the <br />closing of all large capacity cesspools in the County of Hawai`i; and <br />WHEREAS, the County was able to move towards compliance in Honoka'a by <br />utilizing American Reconstruction and Recovery Act funds to construct a sewer system in this <br />town; and <br />WHEREAS, through a mail survey of affected lot owners, approximately 80% of <br />respondents have indicated the need to borrow funds to finance the connection to the sewer <br />system; and <br />WHEREAS, the County has applied for and the State Department of Health has <br />approved a grant proposal to provide financial assistance to those lot owners within Haina <br />wellhead protection zone; <br />WHEREAS, conditions of the grant required certain changes to the Hawai`i County <br />Code, which have been met; <br />WHEREAS, Hawai`i Revised Statutes, Section 46 -7, requires that county <br />departments obtain the consent of the Council to enter into agreements with the federal or <br />state governments respecting action to be taken pursuant to any of the powers granted by law <br />to furnish, expend, and receive any funds or other assistance in connection with projects being <br />or to be undertaken pursuant to those powers; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in <br />accordance with section 46 -7, Hawai`i Revised Statutes, that the Mayor of the County of <br />Hawai` i is authorized to execute, on behalf of the County, a grant agreement, a draft of which <br />is attached hereto and incorporated herein by reference as EXHIBIT "A" with the State of <br />Hawai`i Department of Health to enable the County to provide financial assistance to the lot <br />owners who are required to connect to the sewer system in Honoka`a. <br />
