STATE OF HAWAII <br />SPECIAL CONDITIONS <br />Attachment - S5 <br />1. Deletion of Portions of Contract. For purposes of this Contract, paragraph 5 on page 2 of <br />the Contract, "Standards of Conduct Declaration," together with the attached Standards of <br />Conduct Declaration form are hereby deleted and the parties agree that paragraph 5 of the <br />Contract and its attached form are not operative. <br />2. Deletion of General Conditions. For purposes of this Contract, the following General <br />Conditions are hereby deleted from the General Conditions and have no operative effect <br />between the parties: <br />a. Subparagraph 2.e., 2.g., 2.h., and 2.i. <br />b. Subparagraph 17.d. <br />c. Subparagraph 19.h. <br />3. If this Contract is terminated with cause or without cause or at the scheduled expiration of <br />the time of performance specified in this Contract, all equipment and unused supplies and <br />materials leased or purchased with funds paid to the CONTRACTOR under this Contract <br />shall become the property of the STATE as it so specifies and shall be disposed of as <br />directed by the STATE, except, if applicable, as otherwise may be provided under the <br />Federal Grant. <br />4. Option to Extend Contract. Unless terminated, this Contract may be extended by the <br />STATE for specified periods of time not to exceed one (1) year or for not more than one <br />(1)additional twelve (12) month period, upon mutual agreement and the execution of a <br />supplemental agreement. The Contract price may be adjusted at the beginning of each <br />extension period and shall be subject to allotment and the availability of funds. <br />The STATE may terminate the extended agreement at any time in accordance with <br />General Conditions no. 14. <br />ADM.
