No. 525/Bill No.167, reports as <br /> follows: <br /> Bill No. 167, transmitted by Mayor William P. Kenoi, via Communication No. 525, dated <br /> December 21, 2011, is an Ordinance amending Section 25-8-33 (City of Hilo Zone Map), <br /> Article 8, Chapter 25 (Zoning code) of the Hawaii County Code 1983 (2005 Edition), by <br /> changing the District Classification from Single-Family Residential— 10,000 square feet (RS-10) <br /> to Residential-Commercial Mixed—20,000 square feet(RCX-20), at Waiakea, South Hilo, <br /> Hawaii, covered by Tax Map Key 2-2-038:028. Also enclosed was a favorable <br /> recommendation from the Windward Planning Commission Chair Zendo Kern. <br /> Planning Consultant Sidney Fuke was present to represent the applicant, Takata Dental Health <br /> Center, Inc. <br /> Council Member Ford inquired about which district this was in and if that Council Member was <br /> present. <br /> Mr. Fuke stated that this is in Council Member Onishi's district and he has met and discussed the <br /> Bill with him. He also stated that the applicant was on Oahu at a dental convention and <br /> apologized for not being present. He further stated that the applicant is a third generation dentist <br /> wanting to relocate his business to the family property and build a 4,000 square foot building <br /> with on-site parking. He related that RCX is the most benign commercial zoning and that similar <br /> zoning requests in the same area have been granted. <br /> Committee Chair Hoffmann expressed his support for this bill, but will have to vote "no" as it <br /> contains a fair share clause which he feels is not a legal condition. <br /> Council Member Yagong asked if there was any negative feedback from the Planning <br /> Commission. He also inquired about the amount of parking stalls being planned and if the <br /> existing location of the family home was problematic for building a separate office building. <br /> PC Rept.
