.'JM�V <br /> COUNTY OF HAWAII • ��'=- �% •� STATE OF HAWAII <br /> BILL NO. 196 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 1, OF THE HAWAII <br /> COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO ALCOHOLIC <br /> BEVERAGES. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. The purpose of this measure is to allow the judiciary more <br /> sentencing options of individuals who unlawfully drink alcoholic beverages in public <br /> places. Many of these offenders suffer serious drinking problems and could benefit from <br /> terms of probation that require substance abuse treatment, counseling or a geographic ban <br /> from places where the illegal drinking occurs. <br /> SECTION 2. Chapter 14, article 1, section 14-6, of the Hawai`i County Code 1983 (2005 <br /> Edition, as amended), is amended to read as follows: <br /> "Section 14-6. Penalty. <br /> [Any person violating any provision of this article or any condition set forth in a <br /> --• • . . . -• . • . , upon conviction, be punished by a fine of not more <br /> than $500.] A violation of this article shall constitute a petty misdemeanor. Any person <br /> violating any provision of this article shall be guilty of a petty misdemeanor, and upon <br /> conviction thereof, shall be punishable by a term of imprisonment of not more than thirty <br /> days, a fine not to exceed $1000, or both." <br />
