County of Hawaii <br />WINDWARD PLANNING COMMISSION <br />Aupuni Center • 101 Pauahi Street, Suite 3 • Hilo, Hawaii 96720 <br />Phone (808) 961 -8288 • Fax (808) 961 -8742 <br />MAR 5 2M2f <br />The Honorable Dominic Yagong, Chairman <br />and Members of the County Council <br />County of Hawaii <br />25 Aupuni Street <br />Hilo, HI 96720 <br />Dear Chairman Yagong and Council Members: <br />Change of Zone Application (REZ 11- 000145) <br />Applicant: Karen & Adrian Galan <br />Request: RS -10 to CV -7.5 <br />Tax Map Key: 1- 5- 011:008 and 009 <br />The Windward Planning Commission at its duly held public hearing on February 2, 2012, <br />considered the above - referenced application for a change of zone from Single- Family <br />Residential — 10,000 square feet (RS -10) to a Village Commercial — 7,500 square feet (CV -7.5) <br />zoning district for approximately 17,994 square feet of land. The subject properties are located <br />on the north side of Pahoa Village Road, across from the Pahoa Cash and Carry Store employees <br />parking lot at Nanawale Homesteads, Pahoa, Puna, Hawaii. <br />A motion was made to send a favorable recommendation to the County Council. There were <br />three votes in favor of the motion and one against. Therefore, the motion did not pass. No other <br />motions were made. <br />The three to one vote constitutes a "no action" by the Commission because of the lack of the four <br />affirmative votes required by the Hawaii County Charter, Section 134(I). Under <br />Section 25- 2- 42(d)(3) Zoning Code of the Hawaii County Code and Planning Commission <br />Rule 10- 2(b)(2) the Commission's non - action constitutes an unfavorable recommendation. <br />Accordingly, we are hereby transmitting this letter that explains the unfavorable recommendation <br />of the Windward Planning Commission along with the Planning Director's Background and <br />Recommendation Reports. Also enclosed for your consideration is the proposed bill amending <br />Section 25 -8 -26 (Pahoa Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawaii County <br />Hawai `i County is an Equal Opportunity Provider and Employer <br />
