Applicant: Walua Road Joint Venture

The Planning Commission, after a duly held public hearing on December 5, 1996, voted to
recommend for your approval the proposed legislative bill for approximately 0.533 acres of
land by changing the district classification from Multiple Family Residential (RM-1) to Village
Commercial (CV-10). The property is located between Alii Drive and Walua Road
approximately 370 feet south of the Alii Drive-Walua Road junction at Puaa 3rd, North Kona,
Hawaii.
The applicant proposes to construct a 10,000 square foot, 3-story professional office building
with 25 parking stalls and perimeter landscaping. The Commission also voted to approve the
applicant's request for a Special Management Area (SMA) Use Permit application for the
project.
The Commission concurs with the following Planning Director's reasons for recommending
favorable consideration of the change of zone:
In order to consider an area for any type of zoning designation, the applicable
goals, policies and standards of the General Plan must be adequately addressed. It is
only through such a comprehensive policy analysis approach that evaluations and
decisions can be made to better time and stage developments to achieve growth
determined by the General Plan and related planning documents. The implications of

these evaluations and decisions must be also considered as they may have an impact on
similar areas in the County.
The Change of Zone from Multiple-Family Residential-1,000 square feet per
unit (RM-1) to Village Commercial-10,000 square feet (CV-10) zoned district will
conform to the following General Plan Economic, Commercial and Land Use
Element's goals, policies and standards:
o Designate and allocate land uses in appropriate proportions and mix and in
keeping with the social, cultural and physical environments of the County.
o Zone urban and rural types of uses in areas with ease of access to community
services and employment centers and with adequate public utilities and
facilities.
o Zoning request shall be reviewed with respect to General Plan designation,
district goals, regional plans, State Land Use District, compatibility with
adjacent zone uses, availability of public services and utilities, access, and
public need.
o The County shall encourage the maintenance of communities meeting the needs
of its residents in balance with the physical and social environment.
Approval of this request would also compliment the following goals and policies
of the Commercial Element:
o To provide for commercial developments that maximize convenience to users.
o Provide commercial developments that complement the overall pattern of
transportation and land usage within the island's regions, communities, and
neighborhoods.
o Commercial facilities shall be developed in areas adequately served by
necessary services, such as water, utilities, sewers, and transportation systems.
o Distribution of commercial areas shall be such as to best meet the demands of
neighborhood, community, and regional needs.
o The development of commercial facilities should be designed to fit into the
locate with minimal intrusion while providing the desired services. Appropriate

infrastructure and design concerns shall be incorporated into the review of such
developments.
The proposed use would also conform to the following goals and policies of the
Economic Element:
o Provide residents with opportunities to improve their quality of life.
o Economic development and improvement shall be in balance with the physical
and social environments of the island of Hawaii.
o The County of Hawaii shall strive for diversification of its economy by
strengthening existing industries and attracting new endeavors.
The Land Use Pattern Allocation Guide (LUPAG) Map component of the
General Plan is a representation of the document's goals, policies, standards, and
courses of action. It is also a graphic depiction of the physical relationships among the
various land uses. The LUPAG Map establishes the basic land use pattern for areas
within the County. The LUPAG Map designates the area for Medium Density. Such a
designation may allow Village Commercial uses. The Kailua Village Design Plan has
also designated [he area for Commercial/Residential Mixed Use.
The subject property is situated adjacent to Resort (V-.75), Village Commercial
(CV-10), Single Family Residential (RS-10), and Multiple-Family Residential (RM-1)
zoned districts. Several change of zone applications from RD-3.75 to CV-10 have been
approved to the north of the subject property along Lunapule Road.
Although, there are no curb, gutter and sidewalk improvements in the area,
these roadway improvements along Walua Road are being recommended. Should this
request be approved, similar change of zone requests may be made that would increase
development along this stretch of road. The Department of Public Works stated that
intersection improvements may be warranted at the Walua Road/Alii Drive intersection
(approximately 300 feet to the north), based on the highest use in terms of traffic
generation. However, these improvements are not being recommended due to the
proposal to construct athree-story 10,000 square foot office building complex.
Due to the improved nature of the subject property and the surrounding areas, it
is not anticipated that endangered or threatened candidate species of flora or fauna are
located within the project site, nor has the project site been identified as a significant

botanical or biological habitat. Finally, all other essential utilities are or can be made
available to the subject property.
Based on the above findings, approval of the Change of Zone from Multiple-
Family Residential-1,000 square feet per unit (RM-1) to Village Commercial-10,000
square feet (CV-10) zoned district would result in an appropriate land use pattern and
further the public convenience, necessity, and general welfare.
For your favorable consideration, an amendment to Section 25-89, the Kailua Urban Zone
Map, of the County Zoning Code is transmitted.

Walua Road Joint Venture, has submitted an application for a Special Management
Area (SMA) Use Permit to allow the development of a Professional Center and related
improvements. Also an application for a Change of Zone for approximately 0.533 acres of
land by changing the district classification from Multiple Family Residential (RM-1) to Village
Commercial (CV-10). The property is located between Alii Drive and Walua Road
approximately 370 feet south of the Alii Drive-Walua Road junction at Puua 3rd, North Kona,
Hawaii, TMK: 7-5-18:19.
GENERAL INFORMATION
1. Walua Road Joint Venture is the fee owner of the subject property.
PROPOSED DEVELOPMENT
2. Request: The applicant proposes to construct a 10,000 square foot, 3-story professional
office building with 25-parking stalls and perimeter landscaping.
3. Objectives: "The applicant is proposing to develop a 10,000 SF professional office
building. Prospective tenants include doctors, dentists, lawyers, real estate and other
professionals. The retail rental market will not be targeted."
4. Additional Information: The applicant has submitted the following in support of the

DESCRIPTION OF COUNTY & STATE PLANS
5. SLUC: Urban
6. GP LUPAG MAP: Medium Density Urban Development, which allows for village and
neighborhood commercial and residential and related functions (3-story commercial,
residential-up to 36 units per acre).
7. General Plan Consistency: Economic, Public Utilities, Transportation, Land Use
Commercial elements goals, policies and courses of action for North Kona.

8. Hawaii State Plan Consistency: Economic and Commercial objectives and policies.
9. Kona Regional Plan: The Kona Regional Plan has recommended that the subject area
near the intersection of Alii Drive and Walua Road be designated for Village Commercial
(CV) uses.
10. Kailua Village Design Plan: The parcel is located within the Kailua Village Design
District. The area has been designated Commercial/Residential Mixed Use. The Kailua
Village Design Commission has recommended approval of the project.
11. County Zoning: The site is zoned Multiple Family Residential-1,000 square feet per
unit(RM-1).
12. SMA: The property is situated within the Special Management Area. Therefore, a
Special Management Area Use Permit Application has been filed concurrently with the
Change of Zone Application.
DESCRIPTION OF PROPERTY AND SURROUNDING AREA
13. Subject Property: The subject property has an area of 23,196 square feet. The property
is trapezoidal in shape. The substrate is Punaluu Series (rPYD) which consists of
well-drained thin organic soils over pahoehoe lava bedrock.
14. Surrounding Land Uses/Zoning: Land uses adjacent to the north of the subject
property is a proposed office complex zoned CV-10, Resort(V-.75). Vacant lands to the
south and west on land are zoned Multiple Family Residential (RM-1). In the immediate
vicinity of the subject property are various resort, multiple-family residential and
commercial uses on lands zoned Resort(V-.75), Single Family Residential (RS-10),
Village Commercial (CV-10) and RM-1. Several change of zone requests from RD-3.75
to CV-10 have been approved, to the north, along Lunapule Road.
15. Archaeological Resources: Due to the improved nature of the project site as a
residential homesite and the immediate surrounding area, it is unlikely to contain any
significant historical sites or provide habitat for endangered plants or animal species. A
previous sewer project encountered a lava tube east of Walua Road and the project site.
In the event that another lava tube is encountered, a field investigation will be conducted.

If the lava tube is determined to be significant, then a mitigation plan submitted to the
Department of Land and Natural Resources Historic Preservation Division.
16. Flood Insurance Rate Map: The project site is located in Flood Zone "X".
PUBLIC UTILITIES AND SERVICES
17. Access: Access to the site is provided by Walua Road, which has a right-of-way
varying from 40 to 50 feet with two 10 feet lanes and minimal shoulders.
18. Water: Water is currently available from a 6 inch waterline within Alii Drive. The
anticipated maximum daily water usage is 2400 gallons per day or 4 units of water. An
existing brackish water well on the project site will be retrofitted to provide irrigation
water for the intended xeriscape landscaping.
19. Wastewater: Wastewater will be disposed of through a 4-inch stubout connection to
the 8-inch sewer main along Alii Drive.
20. Utilities: Electrical and telephone service are available to the property.
21. Protective Services: Police protection is provided from its Kealakehe and Captain
Cook stations. Fire Protection is provided from its Kailua-Kona, Kealakehe and
Captain Cook stations. Emergency medical and paramedical services are also provided
by the Hawaii County Fire Department. Kona Hospital at Kealakekua is located
approximately seven (7) miles from the project site and is managed by the State of
Hawaii.

"This is response to your memorandum of October 18, 1996. We are in concurrence with
all the conditions specified in the memorandum."

26. Department of Land and Natural Resources (May 24, 1996 letter):
".At the request of Paul Bleck, a site inspection was made of the subject parcel on May 9,

1996, by Historic Preservation Division staff archaeologist.
"Two residences are located on the parcel and appear to be currently occupied. Because
of the past construction for the residences, and landscaping, we believe that no significant
historic sites are present on the property.
"However, during the construction of the Alii Drive sewer project a lava tube containing
significant cultural material was encountered a short distance mauka of the subject parcel.
"Therefore, it is requested that if a lava tube is encountered during the proposed action,
all work cease in the immediate area and the lava tube be protected from further damage.
The Historic Preservation Division office should be contacted immediately and allowed
to conduct a field investigation of the tube to determine site significance. If the lava tube
is determined to be significant, then a mitigation plan which may include in-place
preservation with appropriate buffer zones and/or data recovery must be agreed upon
before further work can proceed in the area.
"If the above mentioned request is acceptable, then the proposed action can proceed with
'no effect' to significant historic sites. If you have any further questions, please contact
Patrick McCoy at 587-0006 (Honolulu), or Marc Smith at 933-4346 (Hilo)."
27. Police Department(October 29, 1996 Memo):
"This is only one of many small developments that will access Alii Drive via the Walua
Road intersection. The traffic review portion on page 5 fails to address the impact of this
development on the .Alii Drive/Walua Road intersection.
"We request that the developer address the needs for traffic improvements at this
intersection, i.e., future installation and related costs of a traffic light, ingress and egress.
"We foresee a slight increase in traffic and demands for police services should the
application be granted."

28. Kailua Village Design Commission (Meeting of November 12, 1996):
The Kailua Village Design Commission unanimously forwarded a favorable
recommendation to the Planning Director.

PROJECT DESCRIPTION
Project Location
The project, hereinafter referred to as the "project site", is located in the resort town of
Kailua-Kona, approximately .5 miles south of the Alii Drive and Hualalai Road
intersection. The project is, bounded by Alii Drive on the west and Walua Road on the
east, is approximately 200 feet south of the Alii Drive and Walua Road intersection
(Exhibit 1).
Project Objective
This application is for the development of TMK 7-5-18:19 at 75-5874 Walua Road in
Kailua-Kona, HI to its highest and best use. The objective of this project is to create
approximately 10,000 square feet of professional office space within the subject parcel.
The exact mix of professional tenants is not known at this time. However, the intent of
the rental marketing effort will be to target a combination of either medical, dental,
engineering, architectural, real estate and/or related professionals. The intent is not to
create a village retail center.
Accompanying this permit application is a related change of zone application from RM-1
to CV-10.
Present Land Use
The project site has a State Land Use Classification designation of Urban and a Hawaii
County zoning designation of RM-1. The Hawaii County General Plan Land Use Pattern
Allocation Guide Map indicates the site as Medium Density. The Medium Density
designation is described in The General Plan for Hawaii County as being suitable for
village and neighborhood commercial and residential functions.
The project site is surrounded by residential, multiple residential, commercial, and resort
zoned property. It is bounded by Walua Road on the east, Alii Drive on the west, a large
privately owned trust parcel to the south, and a privately owned village commercial parcel
to the immediate north. The subject parcel has been owned by the Smythe family, a well
known kamaaina family that originally migrated from Maui , and its successors for the
past 50 years. Although it has served as the primary residence for the Smythes from 1947
to 1988, it has been used for rental purposes for the last 8 years.
There are two existing older wooden buildings on the project site with four rental units.
One building contains a studio, a one-bedroom and a two-bedroom apartment. The other
building is a one-bedroom cottage with an attached garage. There is an additional
wooden shed that is being used for storage. All structures on the project site will be
demolished prior to construction.

The applicant, Walua Road Joint Venture (WRJV), will assist the existing tenants is
finding suitable housing.
Surrounding Land Use
Directly to the east of the project site and on the east side of Walua Road is TMK 7-5-
18:12 that is zoned RM-1. Kona Mansions, a residential condominium, occupies this
parcel .
Directly to the north is TMK 7-5-18:14, a vacant parcel, owned by James Clay. This
parcel has recently been rezoned from RM-1 to CV-10 pursuant to Council Ordinance
No. 96-34 dated March 13, 1996. Bombadil's Restaurant and Bar (TMK 7-5-9:034), a
commercial enterprise directly adjacent and to the north of Clay's property, is zoned V-
.75.
The parcel adjacent and to the south (TMK 7-5-18:008) , consisting of approximately 18
acres, is zoned RS-10 and is presently undeveloped pasture land.
Directly to the west and makai of Alii Drive is TMK 7-5-18:011 and 7-5-18:78 that are
zoned V-.75 and were formally the site of a miniature golf enterprise and a bar/grill.
Presently, this parcel is vacant.
Proposed Land Use
WRSV is proposing to develop a 10,000 SF professional commercial building on the
project site. The building will be architecturally designed and constructed to maintain
and preserve the Old Kailua Village ambiance.

capable of supplying required fire flow for fire protection
shall be provided to all premises upon which buildings or

department apparatus by roadways meeting the requirements of

" (d) Fire Hydrant Markers. When required by the chief ,
hydrant locations shall be identified by the installation of
reflective markers.
" (e) Timing of Installation. When fire protection facilities
are to be installed by the developer, such facilities
including all surface access roads shall be installed and made
serviceable prior to and during the time of construction.
When alternate methods of protection, as approved by the
chief, are provided, the above may be modified or waived. "

We have reviewed the subject applications.
Water can be made available from an existing 6-inch waterline along Ali ' i Drive.
However, the Hawaii County Fire Department should be consulted for fire protection
requirements.
Pursuant to the Department ' s "Water Commitment Guidelines Policy, " a copy of which
is being forwarded to the applicant, a water commitment may be issued. Based on
the 3 additional units requested in the proposed 4-unit development, the required
water commitment deposit is $450.00.
Remittance by the applicant of $450.00 is requested as soon as possible so that a
water commitment may be formally issued. The commitment will be in writing with
specific conditions and effective dates stated. Please keep in mind that this
letter shall not be construed as a water commitment. In other words, unless a
water commitment is officially effected, water availability is subject to change
depending on the water situation.
Should the subject applications be approved and subdivision applications be
formally executed, final approval will be subject to the following conditions:

1 . Construct necessary water system improvements, which shall include, but not
be limited to:
a. water mains capable of delivering water at adequate pressure and
volume under peak-flow and fire-flow conditions; size of main is
subject to the Fire Department' s fire-flow requirement, and
b. a service lateral that will accommodate the appropriately-sized meter.
2. Submit construction plans and design calculations prepared by a professional
engineer, registered in the State of Hawaii , for review and approval .

Quality Certification (WQC) is required for "Any applicant for
Federal license or permit to conduct any activity including, but

may result in any discharge into the navigable waters. . . " , pursuant
to Section 401( a) ( 1) of the Federal Water Pollution Act (commonly
known as the "Clean Water Act (CWA) " ) .

into State waters, an NPDES general permit is required for each

construction activities, including clearing, grading,

e. Treated contaminated groundwater from underground storage
tank remedial activity.
The application for NPDES general permit - coverage should be
submitted to the Director at least 30 days prior to the discharge
to State waters.
If there is any type of process wastewater discharge from the
facility into State waters, the applicant may be required to apply
for an Individual NPDES permit. The application for an Individual
NPDES permit should be submitted to the Director at least 180 days
prior to the discharge of process wastewater to State waters.

This is in response to your letter with concerns on the subject applications.
We agree that the proposed development will have a slight increase on the traffic and
demands for police services in the area. However, the impact should be minimal and we
do not feel that traffic improvements at the Alii Drive/Walua Road intersection would not
be required for the following reasons:
1. Access to/from the property is not only via the Alii Drive/Walua Road
intersection; but traffic can also access through the Kuakini Highway/Walua
Road and the Lunapule Road/Alii Drive intersections. This would mitigate
additional impact to the Alii Drive/Walua Road intersection.
2. To ensure minimal impact to the Alii Drive/Walua Road intersection, an
alternative would be to restrict egress from the property to right turns only.
3. Development will be specifically for professional commercial office use only.
As such, traffic impact is projected to be minimal.

CHANGE OF ZONE APPLICATION: SMYTHE PROFESSIONAL CENTER
Multiple Residential - 1,000 SF to Village Commercial - 10,000 SF
Walua Road Joint Venture,the applicant, is requesting a Change of Zone for .53 acres of
land from a Multiple Residential -1,000 SF (RM-1) to a Village Commercial - 10,000 SF
(CV-10) zoned district. The parcel is bounded by Alii Drive and Walua Road
approximately 200 feet south of the Walua Road and Alii Drive intersection (Exhibit 1).
APPLICANT'S REQUEST
• Request: The applicant is requesting a change of zone of the subject property,
hereinafter called the "project site," from a Multiple Residential - 1,000 SF
(RM-1)to a Village Commercial -10,000 SF (CV-10) zoned districts.
• Proposed and Existing Use: The applicant is proposing to develop a 10,000
SF professional office building. Prospective tenants include doctors, dentists,
lawyers, real estate and other professionals. The retail rental market will not
be targeted.
The project site is presently being used as a rental property with two
existing older wooden buildings with four rental units. One building contains
a studio, a one bedroom and a two bedroom apartment unit; while the other
building is a one bedroom cottage with an attached garage. There is an
additional wooden shed that is used for storage. All structures on the project
site will be demolished prior to construction.

STATE AND COUNTY PLANNING
The requested change of zone is consistent with the goals and policies of the State Land
Use Designation, and County of Hawaii General Plan.
• State Land Use Designation: The project site is located within an area
designated Urban by the State Land Use Commission.
• General Plan LUPAG Map Designation: The project site is located within
an area designated as Medium Density Urban use. This designation allows for
village and neighborhood commercial use, and multiple family residential use,
provided the goals and policies of the General Plan are met.
• Kailua Village Design Area: The project site is located within the Kailua
Village Design District boundaries. Although it does lie outside of the Special
Design Treatment Area(SDTA) designated by the Kailua Village Design, the
intent of the applicant is to comply as much as possible with the SDTA
guidelines for landscaping, building materials, color schemes, and walls. In
addition, existing utilities lines along Alii Drive will be reinstalled
underground to enhance the ocean views and allow full development of trees.
• County Zoning: The project site is presently zoned Multiple Residential -
1,000 SF (RM-1).
• SMA: The project site is located within the County's Special Management
Area(SMA). The SMA application is being filed concurrently with this
application and is attached.

DESCRIPTION OF PROJECT SITE AND SURROUNDING AREA
• Dimensions: The project site has an area of .53 acres (23,196 SF). Its shape
is trapezoidal with road frontages of 130 feet and 157 feet along Alii Drive
and Walua Road, respectively. The depths of the site are 135 feet and 233 feet
along the northerly and southerly boundaries.
• Physical Characteristics: The project site has two existing older wooden
buildings and a storage shed. The topography is gently sloping at
approximately a 10% slope from Walua Road to Alii Drive. The Alii Drive
roadway is approximately 6 feet below the westerly boundary of the project
site.
• Archaeology: Since the project site has been graded, cultivated and
occupied for the last 50 years, it is unlikely that it contains any significant
historical sites. At the request of the applicant, a site inspection was done by
Marc Smith of the State Historic Preservation Division on May 9, 1996
(Exhibit 2). His inspection indicated that because of the past construction and
landscaping , no significant historic sites were present on the project site. He
did indicate, however, that a previous sewer project encountered a lava tube
mauka of Walua Road and the project site. In the event that another lava tube
is encountered during the project, SHIPO will be notified and the appropriate
corrective measures will be pursued prior to the resumption of construction.

• Flora and Fauna: Due to the prior construction , landscaping and human
habitation on the project site, endangered plants and/or animal species would
not be expected to be present.
• Flooding: The project site does not lie within any floodplains as designated
on the the Federal Insurance Rate Maps (FIRM). On-site generated runoff will
be disposed via shallow drywells.
• Existing Zoning and Land Uses of Adjacent Parcels: The project site is
presently zoned multiple residential (RM-1) with a maximum of one unit per
1,000 SF of buildable area. Permitted uses within this zoning would allow the
construction of apartments or condominiums.
Directly to the east of the project site and mauka of Walua Road is TMK
7-5-18:12 that is zoned RM-1 (Exhibit 3). This parcel, consisting of 2.47
acres, is occupied by the Kona Mansions residential condominium.
Adjacent to the north is TMK 7-5-18:014, encompassing .23 acres,
recently rezoned from RM-1 to CV-10 pursuant to Council Ordinance No.
96-34 dated March 13, 1996. The owner, James Clay, has proposed a two
story office building with law and related offices.
Bombadil's Restaurant and Bar and several office units occupy the .3 acre
triangular parcel adjacent to the north of the Clay property. This parcel,
TMK 7-5-9:034, is zoned V-.75.
Directly to the west and makai of Alii Drive are parcels 7-5-18:011 and 7-
5-18:78, both zoned CV-10 and were formerly the site of a miniature golf
enterprise and a bar/grill. Presently, both parcels are vacant.

Adjacent to the south of the project site is TMK 7-5-18:008. This parcel,
consisting of approximately 18 acres, is presently zoned RS-10 and is in
pasture.
• Traffic: Because of the difference in elevation between Alii Drive and the
project site and because of the negative traffic impact on Alii Drive, vehicular
access will be restricted to/from Alii Drive. However, pedestrian traffic will
have access to and from the project by way of a rock stairway on Alii Drive.
Vehicular access will be from Walua Road only. A traffic count on Walua
Road (Exhibit 5) was done on Thursday, one of the busiest days of the week.
This count was done on July 25, 1996, between 7:00 am and 6:00 pm.. The
busiest times of the day were 7:15 to 8:30 am and 4:00 to 5:30 pm.
Inasmuch as this project will be developed as a professional center, traffic
impact would be minimal since these offices would be closed at night and
weekends. On the contrary, if the project were to be developed as an
apartment or condominium as the existing zoning allows, there would be a
more significant impact on Walua Road.
A total of 25 parking stalls will be provided on the project site, including
two handicapped stalls. These stalls will be fronting Walua Road and will be
mauka of the proposed building site, placing the cars out of sight from Alii
Drive.
• Market Survey: A preliminary market survey was conducted that targeted
professionals. Several of those surveyed indicated interest in renting space
within the project. These included a real estate company of about 12 agents

that presently occupies a 1,500 SF office space, and an attorney. Further, with
the projected growth within this community it is anticipated that there will be
an increased demand for quality professional commercial space.
PUBLIC FACILITIES AND UTILITIES
• Public access: The project site has frontage on both Alii Drive and Walua
Road. Vehicular and pedestrian traffic will have access on Walua Road . Alii
Drive will be restricted to pedestrian traffic only by way of a concrete stairway
within the 6-foot high embankment along Alii Drive.
• Water: There is an existing 5/8-inch meter pesently serving the project site.
Potable domestic water is available from a 6-inch waterline within Alii Drive.
The anticipated maximum daily water usage is 2400 gallons per day or 4 units
of water.
An existing brackish water well on the project site will be retrofitted to
provide irrigation water for the intended xeriscape landscaping .
There is an existing fire hydrant along Alii Drive, 170 feet north of the
project site.
• Sewer: An existing sewer 4-inch stubout has been provided from the 8-inch
sewer main in Alii Drive for sewer disposal at the southwest corner of the
project site. Sewage generated on site will be disposed of through a
connection to this sewer line.
Although the 8-inch sewer main will not be in service until 1997, this will
be prior to the start of construction for this project.

A dumpster will be provided on site for solid waste disposal.
Electricity, Telephone, and Cable: Services for these utilities to the project
site are available from existing lines along the mauka side of Alii Drive.

At the request of Paul Bleck, a site inspection was made of the subject parcel on May 9, 1996, by
Historic Preservation Division staff archaeologist Marc Smith.
Two residences are located on the parcel and appear to be currently occupied. Because of the past
construction for the residences, and landscaping, we believe that no significant historic sites are
present on the property.
However, during the construction of the Alii Drive sewer project a lava tube containing significant
cultural material was encountered a short distance mauka of the subject parcel. Therefore, it is
requested that if a lava tube is encountered during the proposed action, all work cease in the
immediate area and the lava tube be protected from further damage. The Historic Preservation
Division office should then be contacted immediately and allowed to conduct a field investigation
of the tube to determine site significance. If the lava tube is determined to be significant, then a
mitigation plan which may include in-place preservation with appropriate buffer zones and/or data
recovery must be agreed upon before further work can proceed in the area.
If the above mentioned request is acceptable, then the proposed action can proceed with "no
