We have lived on Akala Road for 36 <br /> years and were fortunate to acquire another piece of property next to our primary home. <br /> We raised our three daughters and grandson on Akala Road. Because of the rising <br /> cost of real estate, our wish is to subdivide our property for our children and <br /> grandchildren to afford them an opportunity to become a homeowner. The approval of <br /> our application for rezoning will make this a reality for our family. <br /> On March 1, 2012, the Windward Planning Commission held a hearing regarding <br /> our Change of Zone application. The Commission voted to approve our Change of <br /> Zone application with several conditions. We feel that Conditions F and M need your <br /> consideration. <br /> Condition F states "To provide for future road widening improvements,the <br /> fifteen (15)foot wide future road widening setback along the subject property's <br /> Akala Road frontage shall be subdivided and dedicated to the County of Hawaii <br /> at no cost upon request." The relevance of this setback has come into question since <br /> the adoption of Bill 99 (Exhibit A). Bill 99 was approved by the Council'(final reading) on <br /> November 2, 2011 and adopted by the Mayor on November 14, 2011. The purpose of <br />
