Section 35 -66. Prohibitions. <br />The following prohibitions shall apply: <br />a) Other than provided in this article there shall be no publication dispensing <br />device allowed and no person may install or direct another person to install <br />any publication dispensing device on any public property, sidewalk, or right <br />of way within the district. <br />.(2) Any publication dispensing device installed in violation of this article shall be <br />subject to administrative enforcement including but not limited to removal, fines, <br />cease and desist orders and forfeiture in accordance with section 22 -8.2 of this <br />Code. <br />Section 35 -67. Liability. <br />The County shall not be held liable for the installation, maintenance, operation, or <br />management of any publication dispensing device within the district. <br />Section 35 -68. Rules. <br />The authorized association shall adopt rules for the interpretation, implementation and <br />administration of this article, which shall be subject to the approval of the director. <br />Section 35 -69. Fees. <br />All fees collected by the authorized association pursuant to this article or the rules <br />adopted pursuant to section 35 -71 shall be accounted for in the financial records maintained by <br />the district board pursuant to section 35 -19 and shall be deposited into the account established <br />for the district under this chapter. The financial records of the authorized association including <br />but not limited to all fees collected pursuant to this article shall be subject to review by the <br />public. <br />Section 35 -70. Severability. <br />If any provision of this article or the application thereof to any person or circumstance, is <br />held invalid, the invalidity shall not affect the other provisions or applications of this article <br />which can be given effect without the invalid provision or application, and to this end, the <br />provisions of this article are severable." <br />SECTION 6. Material to be repealed is bracketed and stricken. New material is <br />underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br />underscoring need not be included. <br />SECTION 7. If any provision of this ordinance or the application thereof to any person <br />or circumstance, is held invalid, such invalidity shall not affect other provisions or applications <br />of this ordinance which can be given effect without the invalid provision or application, and to <br />this end, the provisions of this ordinance are declared to be severable. <br />8 <br />
