COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 270 12 <br />A RESOLUTION REQUESTING THE OFFICE OF THE LEGISLATIVE AUDITOR TO <br />CONDUCT A PERFORMANCE AND FINANCIAL AUDIT OF THE DEPARTMENT OF <br />ENVIRONMENTAL MANAGEMENT. <br />WHEREAS, at the April 20, 2012, Special Meeting of the Committee on Finance, <br />Council Members raised serious questions and concerns regarding the operations of the County <br />of Hawaii's Department of Environmental Management; and <br />WHEREAS, these concerns include, but are not limited to, the lack of communication <br />and transparency the department has demonstrated, in particular the County Council was not <br />informed that a pilot program was being conducted to truck trash from Hilo to the Pu`uanahulu <br />Landfill; and <br />WHEREAS, the Department of Environmental Management oversees a number of <br />programs that directly affect the health and safety of our community; and <br />WHEREAS, Section 6-10.2 of the Hawaii County Charter provides that the Department <br />of Environmental Management is established to protect, preserve, and enhance our environment <br />by promoting the wise management of our waste; and <br />WHEREAS, Section 6-10.4 of the Hawaii County Charter provides that the <br />Department of Environmental Management shall manage the solid waste, wastewater, and <br />recycling programs of the county, and exercise functions as prescribed by the mayor or <br />prescribed by ordinance; and <br />WHEREAS, Section 3-18(d) of the Hawaii County Charter provides in part that the <br />Legislative Auditor shall conduct or cause to be conducted: "(2) Performance and/or financial <br />audits of the funds, programs, services, and operations of any county agency, executive agency, <br />or program as set forth by the legislative auditor in an annual audit plan that shall be transmitted <br />to the county council and the mayor and filed with the county clerk as a public record"; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it <br />requests the Office of the Legislative Auditor to conduct a performance and financial audit of the <br />Department of Environmental Management. <br />BE IT FURTHER RESOLVED, that the Council requests the Office of the Legislative <br />Auditor to add this request to its Fiscal Year 2012-2013 annual audit plan. <br />
