COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. 242 <br />99 <br />AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, SECTION 24 -263 <br />OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br />SPEED LIMITS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br />SECTION 1. The purpose of this measure is to create a new 55 mph item for Pahoa- Kapoho <br />Road and to address a safety concern at the eastern terminus of Pahoa - Kapoho Road. A new 35 mph item <br />is being proposed for the last 750 feet adjacent to the eastern terminus of Pahoa - Kapoho Road. <br />SECTION 2. Chapter 24, Article 10, Division 1, Section 24 -263, Schedule 11. 55 mile per hour <br />limit, subsection (g) of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended by adding <br />the following to be appropriately numbered and to read as follows: <br />O <br />Pahoa - Kapoho Road, westbound lane, from Kalapana - Kapoho Beach Road to Pohoiki <br />Road and eastbound lane, from Pohoiki Road and extending seven hundred fifty feet west <br />of Kalapana - Kapoho Beach Road. <br />SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In <br />printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be <br />included. <br />SECTION 4. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or application, <br />and to this end, the provisions of this ordinance are declared to be severable. <br />
