Greenwell Ethnobotanical <br /> Garden, it was clear that the intent of eliminating the restricted use of Condition E was to <br /> allow for a weekly farmers' market, a use that is permitted within the CN-zoning district <br /> provided that the farmers' market is limited to the sale of locally grown/homemade <br /> products no more than two (2) days per week to avoid extensive on-site and off-site <br /> infrastructural and site improvements normally associated with commercial uses. Since <br /> this provision is currently allowed by the Zoning Code, the Planning Director is <br /> recommending that Condition E not be deleted as recommended by Bill No. 255,but <br /> rather amended as substantially recommended by the Planning Commission in 2008, with <br /> a further amendment to accommodate a bi-weekly farmers' market. The Planning <br /> Director's recommended amendment to Condition E of Ordinance No. 08-150 is shown <br /> as follows (material to be deleted is bracketed and struck-out, with added material <br /> underscored): <br /> "E. [This amendment to change the district classification of property is limited <br /> conformance to the description in the current application for reasons of public health, <br /> - ' - - -- :.]For commercial uses other than the <br /> visitor education center and a bi-weekly farmers' market, the applicant shall provide <br /> improvements to the road lot that runs along the entire southeast frontage of the subject <br /> property, consisting of an intersection with Mamalahoa Highway, a 20-foot wide <br /> pavement lane and concrete curb, gutter and sidewalk, drainage improvements, and any <br /> relocation of utilities meeting with the approval of the Department of Public Works prior <br /> to Certificate of Occupancy. For the purpose of this condition, a bi-weekly farmers' <br /> market shall be limited to the sale of local fresh and/or raw produce, plant life, fish and <br /> local homegrown and homemade products for two days a week or less." <br /> The Planning Director also recommends that the following new Condition F be <br /> included to address the Concurrency requirements of the Zoning Code. <br /> F. Should the applicants, successors or assigns develop a land use which the <br /> Planning Depai lnient, in consultation with the Department of Public Works, <br /> determines will generate over 50 peak hour trips, a Traffic Impact Analysis Report <br /> (TIAR) shall be submitted for review and approval by the Department of Public <br /> Works prior to Final Plan Approval. The applicants shall implement, when <br /> required by the Department of Public Works, at no cost to the County, any <br /> transportation system improvements that may be deemed necessary by the <br /> Department of Public Works. <br />
