Attachment 5 <br /> (rev. 8-8-2008) <br /> GENERAL CONDITIONS FOR LEGACY LAND <br /> CONSERVATION PROGRAM GRANT AGREEMENTS <br /> 1. Awardee's Qualifying Standards. <br /> a. The AWARDEE is a state agency, county, or a nonprofit land <br /> conservation organization. <br /> b. If the AWARDEE is a non-profit land conservation organization, the <br /> AWARDEE has been determined by the Internal Revenue Service to be a <br /> non-profit organization, and AWARDEE has a governing board whose <br /> members have no material conflict of interest and serve without <br /> compensation. <br /> 2. Recordkeeping Requirements. The AWARDEE shall, in accordance with <br /> generally accepted accounting practices, maintain fiscal records and supporting <br /> documents and related files, papers, receipts, reports, and other evidence that <br /> sufficiently and properly reflect all direct and indirect expenditures and <br /> management and fiscal practices related to the AWARDEE's performance under <br /> this Agreement. The AWARDEE shall retain all records related to the <br /> AWARDEE's performance under this Agreement for at least three (3) years after <br /> the date of submission of the AWARDEE's Final Project Report. <br /> 3. Audit of AWARDEE. The AWARDEE shall allow the STATE full access to <br /> records, reports, files, and other related documents and information for purposes <br /> of monitoring, measuring the effectiveness, and assuring the proper expenditure <br /> of the grant. This right of access shall last as long as the records and other related <br /> documents are retained. The AWARDEE shall respond to any requests from the <br /> STATE for information regarding monitoring, measuring the effectiveness, and <br /> assuring the proper expenditure of the grant within 60 days. <br /> 4. Nondiscrimination. No person performing work under this Agreement, including <br /> any employee or agent of the AWARDEE, shall engage in any discrimination that <br /> is prohibited by any applicable federal, state, or county law. <br /> 5. Inspection of Property. The AWARDEE shall permit the STATE and its agents <br /> and representatives, at all reasonable times, the right to enter and examine the <br /> Property to ensure compliance with chapter 173A, Hawaii Revised Statutes, and <br /> the terms of this Agreement. The STATE shall provide either written or verbal <br /> notice to the AWARDEE forty-eight hours prior to entering the Property. <br /> 6. Conflicts of Interest. The AWARDEE represents that neither the AWARDEE, <br /> nor any employee or agent of the AWARDEE, presently has any interest, and <br />
