Regarding Bill 178. Our neighborhood is against the apartment building. We are
not opposed the lot being subdivided into 4 TMK's which would allow Mr.
Winegar to achieve the same goal.
Council members Onishi and Smart slandered the petition with 85 signers in
order to shelve the petition at the 09-19-2012 hearing. Some statements made
on the petition came from statements Council member Ford stated at the 02-14-
2012 hearing.
Council member Onishi has been misleading the rest of the council members. He
has been stating the neighborhood is for the apartments.
A County of Hawaii Police report dated 11-07-2012 was also shelved.
Drainage issues are real. After completion of the 2008 Kino'ole Street Roadside
Improvements water pooled and did not drain for 5 months by the retaining wall
at Mr. Winegar's property and my property.
Kino'ole Street is unsafe for people walking and riding bikes along the narrow
shoulder. The street is also narrow. To date very few people walk and ride bikes
on the street. Driving on the street at this point in time is much safer than
walking or riding a bike on the street.
I am requesting to be called to the table to defend the petition .
I have questions for Mr. Onishi, Mrs. Ford, Mr. Nash and Mr. Winegar that need
to be addressed.

The location of this development is surrounded by single family residential homes across the
street and on both sides of the complex. There is the likelihood that this complex will generate
police nuisance calls such as loud party and loud noise complaints affecting the quality of life of

The roadway has one lane for trafficand traffic in this area is constant with
high traffic flow during the morning and afternoon hours.
The parking area in the preliminary site plan identifies over 20 vehicle parking stalls. The plan
calls for 14 three-bedroom apartments to provide housing for University of Hawaii -Hilo students.
If this complex is built, it will have the potential to house more than 42 students without providing
sufficient parking.
Once again, the increase in population density will affect traffic and quality of life for nearby
residents and may increase police calls for service to this area.

Thank you for meeting with us yesterday. As we agreed with you on our site visit, the construction area fronting your
property above, approximately bounded by the new retaining wall, undisturbed lawn area and the adjacent Chong lot
(TMK: 2-2-038:017) will be excavated down approximately two to three feet in depth to the rock layer. To minimize
disturbance and undermining of the new retaining wall, the excavation shall not be less than two feet from the wall.
The excavated area will be backfilled with black ander soil landscape mix from Sanford's Service Center Inc. The
finish grade of the backfill shall provide a positive drainage from the wall to the existing lawn.
It was also agreed that the extent of the above work shall be the only work the County will provide for the above
issue. You will not be afforded any additional work from the County to mitigate this issue in the future.
As explained, after the project is completed, the existing runoff onto your property and in the area will be improved
due to the construction of the swale and drywell. However, during heavy storm -events or in cases where the runoff is
more than the capacity of the drywell, the overflow runoff will flow similar to pre -project condition including possible
runoff flow onto your driveway and low lying areas.
The above work will be done by the County or its Contractor. If you agree, kindly signify your acceptance and
concurrence of the above by signing in the space provided below by Friday, January 9, 2009. We request to call us
when the signed original is ready to be picked -up. A copy is included for your files.

Regarding my property at 1605 IGnoole St (TMK2-2-038:018).
The area of my property that was damaged during the Roadside Improvement *STP0100(059)
has not yet been restored to the existing condition the property was in before the project began.
When re -installing my fence I ran string lines to find the property line. I found that my property is still
12 to 18 inches lower than it was before construction started.
I was told by Alan Simeon and various staff from Isemoto Contracting including Jason that the last phase of
the project was to bring in good soil and place the soil at the bottom of the retaining wall weep hole and
would be graded from said wall to the existing land area. Thus the soil would be graded to give positive
drainage from the wall into my yard.
To date the job is not complete. The sol was never placed to the bottom of the weep holes. It was placed 6
inches plus under the weep holes. This is one reason why my yard is 12-18 inches lower. When you
purchased the 5 feet of property that also changed the topography. Perhaps that 5 ft was not taken into
consideration when the project was engineered. The fact you shot your elevations without first grubbing the
Chong property also is a factor.
During the excavation phase to try to correct the damage to my property I took some measurements to see
how much material was needed. 9-10 truckloads (Black ander soil mix) from Sanford were required. To
date 3 loads were delivered to my property.
Sink holes are now occurring in my yard. I also noticed a lot of pre-eDdsting sol was mixed in with the
ander soil mix that was put in the construction area of my property.
My request is for 3 more truckloads of material from Sanford rather than 6 more truckloads of material from
Sanford since my fence is up and trees are planted.
