B ■ JO . <br /> 1 (b) The definition of "indigent" shall be based on an objective <br /> 2 determination of annual income and other resources, and <br /> 3 shall comply with the following: <br /> 4 a . For misdemeanor cases, criminal defendants must earn <br /> 5 less than one hundred twenty-five percent (125%) of <br /> 6 the Federal Poverty Guidelines in order to qualify as <br /> 7 indigent. <br /> 8 b. For felony cases, criminal defendants must earn less <br /> 9 than one hundred fifty percent (150%) of the Federal <br /> 10 Poverty Guidelines in order to qualify as indigent. <br /> 11 (c) Financial Standards for Determining Indigence. <br /> 12 (1) The financial standards set forth below shall be used <br /> 13 to determine whether a defendant is indigent and shall <br /> 14 be applied equally to each defendant in the county.
