No. 321-12 <br /> PLACE: Council Chambers <br /> Kailua-Kona, Hawai`i <br /> TIME: 11:08 a.m. <br /> Council Chair and Members <br /> Hawai`i County Council <br /> Hilo, Hawai`i 96720 <br /> Your Committee on Finance, to which was referred Resolution No. 321-12, reports as follows: <br /> Resolution No. 321-12, transmitted by Senior Deputy Corporation Counsel Joseph K. Kamelamela via <br /> Communication No. 903, dated October 23, 2012, authorizes accepting the donation of Lots 59-A-2 and <br /> 59-A-3 situated at Kalopa, District of Hamakua, County and State of Hawai`i, being Tax Map Key: <br /> (3)4-4-008:142 (por.), from Alfred F. Nibecker, Jr. and Sandra J. Nibecker, as Co-trustees under that <br /> certain Nibecker Family Trust, dated March 14, 2000. These lots will be donated to the County due to <br /> the paved County road encroaching on the Nibecker's property. The Nibecker Trust will be elevated of <br /> any liability they may have with a public roadway on their private property. <br /> Committee Member Yagong wanted to thank the Administration for their diligence and hard work on <br /> taking care of this issue. <br /> Pursuant to Article XIII, Section 13-12, Hawai`i County Charter, the Council, on behalf of the County, <br /> may accept gifts or donations of money. <br /> A letter of appreciation and a copy of this resolution will be sent to Alfred F. Nibecker and Sandra J. <br /> Nibecker, P.O.
