No. 38 -13 <br />PLACE: Council Chambers <br />Kona, Hawaii <br />TIME: 9:01 a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Committee on Finance, to which was referred Resolution No. 38 -13, reports as follows: <br />Resolution No. 38 -13, transmitted by Senior Deputy Corporation Counsel Joseph K. Kamelamela, via <br />Communication No. 18 dated December 28, 2012, authorizes the grant of easement for drainage <br />purposes at Puapua`a 1St and 2 and H61ualoa 1St and 2nd, District of North Kona, County and State <br />of Hawaii , Tax Map Key: (3)7 -6- 0012:034 to the County of Hawaii. <br />David G. Wilkinson and Kimiko Wilkinson are the current owners of Lot 2 -A. The easement will be <br />used to install a catch basin/drywell needed to minimize runoff to downstream properties. <br />Senior Deputy Corporation Counsel Joseph K. Kamelamela appeared before Your Committee for <br />questions. <br />Mr. Kanuha called upon Mr. Kamelamela for clarification on the third WHEREAS clause in the <br />resolution pertaining "at no cost to the County." The phrase was thought to be misleading due to word <br />placement. It was asked of Mr. Kamelamela, by Ms. Ford, to amend this phrase, "at no cost to the <br />County" to be placed after "easement." Mr. Kamelamela agreed to submit proposed language prior to <br />the next hearing. <br />Pursuant to Article XIII, Section 13 -12, Hawaii County Charter, the Council, on behalf of the County, <br />may accept gifts of donations of money, securities or other personal property or of real estate or any <br />interest of real estate. <br />A letter of appreciation and a copy of this resolution will be sent to David G. Wilkinson and Kimiko <br />Wilkinson, P.O. Box 370, H61ualoa, Hawaii 96725, acknowledging this generous donation. <br />FC Report No. 28 <br />
