AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, <br /> SECTION 24-257 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS <br /> AMENDED), RELATING TO SPEED LIMITS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. The purpose of this measure is to lower the speed limit along <br /> Mamalahoa Highway south of the Ala Ohia Road (Waimea bypass) intersection. With the <br /> subject speed limit change, the design criteria specifically for the left-turn pocket into the <br /> Ala Ohia Road intersection will be met within the existing right-of-way. <br /> SECTION 2. Chapter 24, Article 10, Division 1, Section 24-257, Schedule 5. 35 <br /> mile per hour limit, subsection (e), Kohala, of the Hawai`i County Code 1983 (2005 Edition, <br /> as amended), is amended by revising existing item: <br /> (1) Mamalahoa Highway(Highway 190), [in Waimea] from Lindsey Road to <br /> the end of the County-maintained portion eighty-one feet south of <br /> Lalamilo Farm Road [to a point four thousand feet in the Kona direction]. <br /> SECTION 3. Material to be repealed is bracketed and stricken. New material is <br /> underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br /> underscoring need not be included. <br /> SECTION 4. Severability. If any provision of this ordinance, or the <br /> application thereof to any person or circumstance, is held invalid, such invalidity <br /> shall not affect other provisions or applications of the ordinance which can be given <br /> effect without the invalid provision or application, and to this end, the provisions of <br /> this ordinance are declared to be severable. <br /> SECTION 5. This ordinance shall take effect upon its approval. <br />
