' <br /> COUNTY OF HAWAII -; " %1.- STATE OF HAWAII <br /> RESOLUTION NO. 61 13 <br /> A RESOLUTION URGING THE HAWAII STATE LEGISLATURE TO PASS <br /> LEGISLATION PERMITTING THE COUNTY OF HAWAII TO EXPEND A PORTION <br /> OF THE COUNTY'S SHARE OF FUEL TAX REVENUE FOR THE MAINTENANCE <br /> OF SUBSTANDARD PRIVATE SUBDIVISION ROADS WHICH ARE USED BY THE <br /> PUBLIC. <br /> WHEREAS, in Section 243-6 of the Hawai`i Revised Statutes, the "county of Hawai`i <br /> fuel tax" shall "be paid over to the director of finance of the county of Hawai`i for deposit into <br /> the fund known as the `highway fund' created by section 249-18"; and <br /> WHEREAS, Section 249-18 of the Hawai`i Revised Statutes, dealing with the highway <br /> fund, does not currently allow for highway fund money to be spent on the maintenance of <br /> substandard private subdivision roads which are used by the public; and <br /> WHEREAS, Senate Bill No. 382 and House Bill No. 101 were introduced at the Hawai`i <br /> State Legislature on January 18, 2013—bills which would permit the county of Hawai`i to <br /> appropriate a share of fuel tax revenue for the maintenance of private subdivision roads, <br /> provided that they are substandard and utilized by the public; and <br /> WHEREAS, many substandard private subdivision roads within the county of Hawai`i <br /> are utilized by the public, but not currently eligible for improvements funded through money <br /> derived from the county of Hawai`i fuel tax; and <br /> WHEREAS, substandard private subdivision roads may provide for hazardous driving <br /> conditions, not only for residents of private subdivisions, but also for county of Hawai`i <br /> emergency service workers, school buses, public transportation, and tourists who use these roads <br /> to either provide services or access coastal or mountain resources; and <br /> WHEREAS, on January 29, 2013, both the Senate Committee on Public Safety, <br /> Intergovernmental and Military Affairs, and the Senate Committee on Transportation and <br /> International Affairs, recommended that Senate Bill No. 382 be passed, unamended; now, <br /> therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> 2013 Hawai`i State Legislature is hereby urged to pass legislation permitting the county of <br /> Hawai`i to expend a portion of the county's share of fuel tax revenue for the maintenance of <br /> substandard private subdivision roads which are used by the public. <br />
