COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />78 13 <br />A RESOLUTION REQUESTING THE LEGISLATIVE AUDITOR TO CONDUCT AN <br />AUDIT OF THE POLICE DEPARTMENT'S RECEIPT, STORAGE, AND DISPOSAL <br />OF EVIDENCE. <br />WHEREAS, the Police Department has the responsibility to obtain, store, and dispose of <br />evidence, prisoner property, and items found by police officers; and <br />WHEREAS, Section 3-18(d) of the Hawaii County Charter provides in part that the <br />Legislative Auditor shall conduct or cause to be conducted "Performance and/or financial audits <br />of the funds, programs, services, and operations of any county agency, executive agency, or <br />program, as set forth by the legislative auditor in an annual audit plan that shall be transmitted to <br />the county council and the mayor and filed with the county clerk as a public record."; and <br />WHEREAS, to promote public confidence and in an abundance of caution, an audit of <br />the Police Department's handling of evidence is appropriate to ensure that the retrieval, storage, <br />and disposition of evidence and confiscated property is being properly carried out; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br />Council hereby requests the Legislative Auditor to conduct an audit of the Police Department's <br />handling of evidence and confiscated property for the past three years. <br />BE IT FURTHER RESOLVED that the audit shall consist of, but not be limited to, the <br />following: <br />1. Ensuring that property is appropriately obtained, stored, transported, handled, and <br />disposed of, <br />2. An audit of the adequacy of the Police Department's internal management <br />control procedures and physical security of the property and evidence areas from <br />the point the evidence and confiscated property is identified to the final <br />disposition of the property and evidence; and <br />3. A performance audit to ensure the proper documentation of transactions and <br />events. <br />BE IT FURTHER RESOLVED that the Legislative Auditor shall conduct a physical <br />inventory of the property currently under the control of the Police Department with reference to <br />the associated police report or other relevant documentation of identified evidence and <br />confiscated property. <br />
