Pursuant to Hawaii County Code (HCC) Sec. 3-22(a), I am forwarding Hawai'i Tire Company,
LLC's completed application for a sign variance. The owner of the property is Lanihau
Properties, LLC and the applicant is Josh Porter of Hawaii Tire Company, LLC whose phone
number is (808) 961-6601. The applicant is requesting a sign variance for a wall signs at two
buildings. The proposed signs at the Lex Brodie's Tire Store are 22sf each in area with 14 inch
high lettering and a 33 inch symbol mounted at 16 feet above finish grade. The proposed signs
at the `Fastlube' building are 22sf each in area with a total of 18 inch high lettering and a 30 inch
symbol mounted at 17 feet above finish grade. All signs at each building are located on the
parapet. The maximum allowable letter and/or symbol is nine inches per section 3-58(c) chapter
3, Hawaii County Code. The business is located in ML zone which limits the wall sign to nine
feet in height per section 3-59(a)(4) chapter 3, Hawaii County Code. Signs are prohibited in
Kailua Village when attached to a building extends above the lowest edge of any portion of the
roof or mansard roof per section 3-61(a)(2) chapter 3, Hawaii County Code.

(7) Filings Fees: This application must be accompanied by a fee of $100 for each sign or an amount
equal to 10% of the total value of the sign(s), excluding installation costs, whichever is greater,
payable to the County Director of Finance.
(8) Applicant must provide written explanations for the following (please attach sheets):
(a) Granting the variance is necessitated by the peculiar physical conditions not ordinarily
found in most districts, because of the peculiarity of a business, or as a result of a special
event or circumstance;
(b) Granting the variance will not adversely affect the rights of adjacent property owners or
tenants;
(c) Granting the variance will not unreasonably violate the interest, safety, convenience, or
general welfare of the public;
(d) A strict application of the terms of this chapter would work unnecessary hardship and
practical difficulty upon the applicant or community;
(e) Granting the variance will not constitute a grant of personal or special privilege
inconsistent with the limitations upon other properties under identical ordinances, statutes
or rules.

This letter is to inform you that the Kailua Village Design Commission, at its October 9, 2012
meeting, voted to recommend to the Public Works Director the approval of the above - referenced
sign variance application subject to the following conditions and design changes:
1. No changes to the design of the Lex Brodie's tire store signage are suggested as the
Commission found the sign variance request for this more distant building to be reasonable.
2. For the Quicklube building signage, the "Pennzoil" name and logo is to be removed as it was
found to make that signage undesirably complex, "busy" or excessive. Only the "Little Joe"
Lex Brodie logo and associated lettering is to remain, as the applicant preferred, if one logo
had to be removed for a favorable recommendation from the Commission.
3. The maximum letter height for the Quicklube name should be twelve (12) inches, in lieu of
the larger size proposed in the variance application.
4. The letter height for the second line of lettering (" 10 minute oil change ") may be increased to
a maximum height of six (6) inches in lieu of the smaller height proposed in the variance
application.
5. The Commission's conditionally favorable recommendation for the over -sized signage,
subject to the above modifications, is based on the applicant's commitment to keep the site —
particularly but not only the landscaped frontages — free of "sign clutter:" continually placed
or rotated promotional banners, pennants, sandwich boards, sign -like monuments and other
extraneous materials, regardless of whether such items might comply with the Sign Code.

REVIEW PROCEDURES and APPLICANT CHECKLIST
for SIGN PERMIT applications
in the Kailua Village Special Design District
The Dept. of Public Works, Building Division (DPW- Building) administers the County of Hawaii Sign
Code, which includes special regulations for signs in the Kailua Village Special Design District. For more
information on the Sign Code and the special design, size and placement restrictions applicable to signs in the
Kailua Village Special Design District, contact DPW - Building (tel. 323 - 4720). (The Sign Code is available
on the internet at www.hawaiicotinty. ov; search for "Hawaii County Code" and open link for Chapter 3)
Article 2 of the Sign Code requires that Sign Permit applications within the "Kailua Village Special Design
District" must be forwarded to the Kailua Village Design Commission (KVDC), for its review and
recommendations, prior to sign permit approval by DPW - Building.
Most or all of the lands identified in the Tax Map Key Plats identified below are within the Kailua Village
Special Design District:
7 -4 -08; 7 -4 -10; 7 -4 -15; (most of the Kailua Industrial Area)
7 -5 -03; 7 -5 -04; 7 -5 -05; 7 -5 -06; 7 -5 -07; 7 -5 -08; 7 -5 -09; 7 -5 -10;
7 -5 -17; 7 -5 -18; 7 -5 -22; 7 -5 -23; 7 -5 -26; 7 -5 -30; 7 -5 -31.
Within Kailua Village Special Design District, different sign area (size) and letter /logo height regulations
apply to signs in the "Kailua Village Core," and signs in the "Kailua Industrial Subdivision." The Kailua
Village Core is the area bounded by or adjacent to Ali'i Drive, Palani Road, Kuakini Highway, and Lunapule
Road. The Kailua Industrial Subdivision includes portions of Tax Map Key Plats 7-4 -10 and 7 -4 -15. Consult
the attached map to determine if a proposed sign is in the Kailua Village Special Design District, the "Kailua
Village Core," or the "Kailua Industrial Subdivision," and submit the sign permit application and KVDC
forms with copies as described below for KVDC review at a scheduled public meeting.
For signs in the Kailua Village Special Design District, in addition to the standard Sign Permit Application
materials required by DPW - Building, the applicant must submit to DPW - Building an original plus ten copies
(11 sets total) of the following three documents: (1) the KVDC Referral form; (2) the attached Checklist; and
(3) the Sign Permit Application form and its required attachments. All forms must be sited by the parties
listed thereon. After these documents are submitted, verified as complete and referred to the KVDC, a public
meeting of the Commission will be scheduled to review the design of proposed sign, and the applicant will be
informed of the meeting date, time and location. Both the applicant and business owner are expected to bg
,present at the review meeting to address any questions raised by KVDC commissioners in relation to the
signage design guidelines set forth in both Section 3 -54 of the Sign Code and the Master Plan for Kailua -
Kona. The KVDC's recommendation is forwarded to DPW - Building for its Director's consideration.
Prohibited Signs: In addition to the prohibited signs listed in Article 1, Sect. 3 -7 of the Sign Code, the
Kailua Village has additional prohibited sign types as specified in Article 2, Section 3 -61. The following are
prohibited in Kailua Village:
(1) Any sign or display which is constructed primarily of materials with a shiny, slick, or reflective surface such
as fiberglass or acrylic plastic.
(2) Any sign which is displayed on any roof or mansard roof, or when attached to a building extends above the
lowest edge of any portion of the roof or mansard roof.
(3) Any sign which has a vertical clearance of less than nine (9) feet or projects, extends, or is otherwise displayed
over or above any public street, park, other public places or pedestrian way, except as may be permitted by Section
3 -62 or Chapter 22.
(4) Any sign for product advertising when visible to the general public. A sign containing only the name of a
business is not a sign for product advertising.
(5) Any mechanical sign, graphic design or decorative element that functions through animation, revolvement, up,
down, sidewards or any other similar movement, including but not limited to, any spinning device, light bulb border,
flashing or mobile illumination.

1. The subject parcel is the only parcel zoned ML -20 (Limited industrial) in the Kailua Village Design
District that is not in the Kailua Industrial Subdivision. (Kailua Industrial Sub. allows for much
larger signs)
2. Both businesses, Tire store Er Quiklube, will cater to a mobile clientele, rather than pedestrians on
foot.
3. The existing building (future tire store) is setback from the street approximately 80' -0 ". Making
wall signage at a max. 9' ht. / 9" high lettering difficult to read from the road.

(b) (8) An Explanation of why granting the variance will not adversely affect the rights of adjacent
property owners or tenants, including an explanation of alternative measures, if any, that the applicant
is proposing to take in lieu of compliance with applicable code section.
1. We feel that the proposed signage will not adversely affect the adjacent properties in any way.
The proposed signage is similar to existing signage on adjacent buildings.

1. With the Tire Store and the Quicklube we plan to provide a clean, convenient, safe location for
the public to have their vehicles serviced and tires changed. We feel the proposed signage will be
a compliment to the new and remodeled buildings, and provide the public with a clear
understanding of who we are and the services that we can provide.
