No. 103/Bill No. 33 PLACE: Council Chambers Hilo, Hawai`i TIME: 11:05 a.m. Council Chair and Members Hawai`i County Council Hilo, Hawai`i 96720 Your Committee on Planning, to which was referred Bill No. 33, reports as follows: Bill No. 33, transmitted by Mayor William P. Kenoi, via Communication No. 103, dated January 11, 2013, forwards a favorable recommendation from the Leeward Planning Commission amending Ordinance No. 07-160 which amended Ordinance No. 97-56, which reclassified lands from Agricultural-5 Acres (A-5a)to Single Family Residential-10,000 Square Feet (RS-10) at Kalaoa 4` ,North Kona, Hawai`i, covered by Tax Map Key 7-3-028:082— 102 formerly (7-3-010:037) (Applicant: RS 10 Kalaoa, LLC). This is a request for a 5-year time extension to comply with Condition D (final subdivision approval) and Condition J (fair share requirements). The applicant is in the process of subdividing and developing a total of 31 residential lots. Increment I has been completed, which consists of 20 lots. The deadline to secure Final Subdivision Approval for Increment II under Change of Zone Ordinance No. 07-160 was October 19, 2012. The applicant had every intention of trying to meet the current deadline based on the completion of a number of conditions, but given the current serious economic slump; the applicant felt it was not feasible and not prudent to move forward with the project at this time considering current construction costs. Although this request is for amendments to Conditions D (final subdivision approval) and Condition J (fair share requirements) there was also some concerns expressed with regards to Condition K (affordable housing requirement). For informational purposes, this item was postponed on February 19, 2013 to allow Council members time to get more information from the Hawai`i Housing Authority. PC Rept. No.: 31
