6 J�tY OF N��'',• COUNTY OF HAWAII -- _ STATE OF HAWAII RESOLUTION NO. 98 13 A RESOLUTION ACKNOWLEDGING RECEIPT OF A CORRECTED MAP, PRELIMINARY ASSESSMENT ROLL, DESCRIPTION OF ASSESSMENT UNITS TO BE ASSESSED AND CONSTRUCTION CONTRACT BID OF THE LOWEST RESPONSIBLE AND RELIABLE BIDDER FOR A WATER SYSTEM IMPROVEMENT DISTRICT FOR THE KONA OCEAN VIEW PROPERTIES SUBDIVISION, AND SETTING THE DATE, TIME, AND PLACE OF A PUBLIC HEARING TO BE HELD CONCERNING SUCH ITEMS PURSUANT TO SECTION 12-27, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED). WHEREAS, pursuant to Sections 12-17 and 12-18, Hawai`i County Code 1983 (2005 Edition, as amended), and Resolution No. 99-11 adopted pursuant to such Sections on August 3, 2011, the Hawai`i County Council (the "Council") determined to create, define and establish a Water System Improvement District (the "Improvement District") for the purpose of funding certain special improvements consisting of a public water system to serve the Kona Ocean View Properties Subdivision (the"Special Improvements"); and WHEREAS, Resolution No. 301-12 was adopted on September 19, 2012, to approve and adopt a corrected map of the special improvements to be constructed or improved, together with final details, and plans and specifications for a Water Delivery System for the Kona Ocean View Properties Subdivision; and WHEREAS, pursuant to Section 12-27(a) and (b), Hawai`i County Code 1983 (2005 Edition, as amended), the Manager-Chief Engineer of the Department of Water Supply (the "Manager") has submitted to the Council (a) a corrected map of the Special Improvements, as attached as Exhibit A hereto (the "Corrected Map"), (b) a preliminary assessment roll for the Improvement District, as attached as Exhibit B hereto (the "Preliminary Assessment Roll"), (c) a description of assessment units to be assessed within the Improvement District, including the method of assessment of each assessment unit, the maximum proposed assessment for each assessment unit and a list of all known owners of the assessment units, as attached as Exhibit C hereto (the "Description of Assessment Units"), and (d) the construction bid for the Special Improvements provided by the lowest responsible and reliable bidder, as attached as Exhibit D hereto (the "Construction Bid"); and WHEREAS, the Council intends hereby to acknowledge receipt of the foregoing documents and to set the time, date and place of a public hearing to be held concerning such items pursuant to Section 12-27 of the Hawai`i County Code; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Council hereby acknowledges receipt of the Corrected Map, Preliminary Assessment Roll, Description of Assessment Units and Construction Bid relating to the Improvement District and the Special Improvements, all in the respective forms attached as Exhibits A through D hereto. BE IT FURTHER RESOLVED that a public hearing regarding the matters set forth in the Corrected Map, Preliminary Assessment Roll, Description of Assessment Units and Construction Bid shall be held at 6:00 p.m. on June 4, 2013, at the West Hawai`i Civic Center Council Chambers. The Clerk shall cause notice of the public hearing to be advertised, mailed and posted in the same manner as provided in Section 12-10 of the Hawai`i County Code. Such notice shall include information regarding the total cost of the Special Improvements, the contents of the Preliminary Assessment Roll, that the Corrected Map, Preliminary Assessment Roll and Description of Assessment Units will be available for inspection at the Office of the Manager-Chief Engineer of the Department of Water Supply during business hours prior to the public hearing, and the time, date, and place of the public hearing. BE IT FURTHER RESOLVED that this Resolution shall take effect immediately upon adoption thereof BE IT FINALLY RESOLVED that the County Clerk shall transmit copies of this Resolution to: the Honorable Mayor William P. Description of Assessment Units For purposes of the Improvement District, the term "assessment unit" shall mean a duly subdivided parcel of land or condominium unit within the Improvement District bearing a unique tax map key number. The assessment units are currently comprised of TMKs 7-2-008:1-41 (excluding lot 39, which is not part of the Subdivision) and TMKs7-2-09:1-42 (excluding lot 41, which is the road lot), as identified on the Preliminary Assessment Roll attached as Exhibit B to the foregoing Resolution, it being understood that such assessment units are subject to subdivision or consolidation from time to time as provided in Section 12-30, Hawai`i County Code 1983 (2005 Edition, as amended). Method of Assessment Each assessment unit existing as of the date that assessments begin to accrue on assessment units within the Improvement District shall be subject to an assessment calculated by dividing the "net project costs" (as defined below) by the number of assessment units within the Improvement District as of such date, subject to adjustment in the event of subdivision or consolidation of assessment units as provided in Section 12-10, Hawai`i County Code 1983 (2005 Edition, as amended). For purposes of the foregoing, the term "net project costs" shall mean the cost of designing,constructing and installing the Special Improvements(including related administrative and financing costs), less any grants which reduce the actual costs of the Special Improvements to the County. By way of example: (i) The current budget for the Special Improvements reflects a total cost of the Special Improvements of $1,569,369 and a $353,369 grant from the U.S. Department of Agriculture Rural Development to be applied against such costs, resulting in net project costs of$1,216,000; and (ii) The Preliminary Assessment Roll indicates that there are eighty-one (81) assessment units in the Improvement District. Assuming that the net project costs and total number of assessment units are as indicated above, the assessment for each assessment unit would be $15,012.35 (i.e., $1,216,000 ± 81 = $15,012.35), subject to adjustment in the event of subdivision or consolidation of assessment units as referred to above.
