STATE OF HAWAII , E'OF NF's' RESOLUTION NO. 109 13 A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A MULTI-YEAR HOUSING ASSISTANCE PAYMENT CONTRACT (AGREEMENT) WITH MOHOULI SENIOR PHASE 1, LLP, OWNER OF THE MOHOULI HEIGHTS NEIGHBORHOOD PROJECT PHASE I (PROJECT), SELECTED FOR THE SECTION 8 PROJECT- BASED VOUCHER PROGRAM (PBV PROGRAM) AS OFFERED THROUGH A PUBLIC NOTICE DATED DECEMBER 1, 8, AND 15,2010. WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of more than one fiscal year, be approved by resolution; and WHEREAS, the Office of Housing and Community Development (OHCD)published a Public Notice in the local newspapers informing property owners that the OHCD was accepting proposals for the Section 8 Project Based Voucher Program; and WHEREAS, under the Project-Based Voucher Program, the OHCD will attach a Section 8 Housing Assistance Payment Contract (Agreement)to an existing structure or to a structure if the owner agrees to rehabilitate or construct the structure other than with assistance provided under the United States Act of 1937; and WHEREAS, the purpose of the Section 8 Project-Based Voucher Program is to encourage property owners to make available rental housing units to low-income families that are not within the current housing fair market rents; and WHEREAS, the OHCD would like to assist twenty (20) units in the County of Hawai'i under the funding available for this purpose; and WHEREAS, the County of Hawai'i wishes to enter into a multi-year agreement with Mohouli Senior Phase 1, LLP, owner of the Mohouli Heights Neighborhood Project Phase I ("Owner") selected as a Section 8 Project-Based Voucher project(the "Project")by the OHCD utilizing the Section 8 Project-Based Voucher Program's evaluation process; and WHEREAS, the OHCD is requesting authorization for the Mayor to enter into a multi- year agreement with Owner for the Project; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that the Mayor is hereby authorized to enter into a multi-year agreement with Owner for the Section 8 Project-Based Voucher Program offered through the Public Notice dated December 1, 8 and 15, 2010.
