Poindexter, Council Member <br /> SUBJECT: Proposed Amendments to Resolution No. 106-13, Draft 2; A Resolution <br /> Accepting the Negotiated Lease Agreement for Hamakua Lands Identified as <br /> Tax Map Key (3) 4-3-009-059 with Frank Commendador, Pursuant to Section <br /> 2-114 of the Hawai`i County Code <br /> Please see below proposed amendments to Resolution No. 106-13, Draft 2, to conform the <br /> reference to the lease agreement (now labeled "Exhibit "A" Draft 2") to its corresponding <br /> references within the resolution. The amendments are illustrated by Ramseyer format (material to <br /> be added is underscored). <br /> 1. Resolution No. 106-13, Draft 2, is amended by amending the third WHEREAS clause to <br /> read as follows: <br /> "WHEREAS, the negotiated lease agreement with Frank Commendador attached hereto as <br /> Exhibit "A" Draft 2 for Tax Map Key (3) 4-3-009-059 is presented to the County Council pursuant <br /> to Resolution 38-11; and" <br /> 2. Resolution No. 106-13, Draft 2, is amended by amending the enacting clause to read as <br /> follows: <br /> "BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br /> negotiated lease of Tax Map Key (3) 4-3-009-059 to Frank Commendador under the terms and <br /> conditions as noted in the Lease attached hereto as Exhibit"A" Draft 2 is hereby accepted." <br /> In an effort to conserve resources, a draft copy of Resolution No. 106-13, Draft 3, has not <br /> been attached. <br /> VTP/sc Comm.
