REPORT OF THE COMMITTEE ON FINANCE DATE: April 30, 2013 Re: Comm. No. 247/Res. No. 105-13 PLACE: Council Chambers Kona, Hawai`i TIME: 1:00 p.m. Council Chair and Members Hawai`i County Council Hilo, Hawaii 96720 Your Committee on Finance, to which was referred Resolution No. 105-13, reports as follows: Resolution No. 105-13, transmitted jointly with Bill No. 65, by Finance Director Nancy Crawford via Communication No. 247, dated April 12, 2013, authorizes the Director of Finance to issue a refund of a rollback tax and penalty for breach of an affordable housing dedication totaling two thousand six hundred seventy four and 93/100 dollars ($2,674.93). A proposed floor amendment was verbally made by Council Member Poindexter to correct the spelling of the word "Totaling" in the title of Resolution No. 105-13. The amendment was approved unanimously. Ms. Crawford appeared before Your Committee. She stated that Mr. Taniguchi received a refund because he caused a breach by transferring his property within the year it was dedicated. Ms. Ford spoke in support of the resolution. She commended Ms. Crawford for recognizing the conflict in the code pertaining to the two-year plus current rollback penalty, and her willingness to set forth Bill No. 65 to correct the code with a rollback penalty to the date of reclassification, but no more than the current year. Pursuant to Chapter 19, Article 1, Section 19-3(12), Hawai`i County Code, the Director of Finance shall obtain the approval of the County Council for refunds for claims arising from Chapter 19 in excess of Five Hundred Dollars ($500). Your Committee on Finance is in accord with the purpose and intent of Resolution No. 105-13, as amended to Draft 2, and recommends its adoption.
