REPORT OF THE COMMITTEE ON FINANCE DATE: April 30, 2013 Re: Comm. No. 248/Res. No. 106-13 PLACE: Council Chambers Kona, Hawai`i TIME: 1:00 p.m. Council Chair and Members Hawai`i County Council Hilo, Hawai`i 96720 Your Committee on Finance, to which was referred Resolution No. 106-13, reports as follows: Resolution No. 106-13, transmitted by Finance Director Nancy Crawford, via Communication No. 248 dated April 12, 2013, accepts the negotiated lease agreement for Hamakua lands identified as Tax Map Key (3)4-3-009-059 with Frank Commendador, pursuant to Section 2-114 of the Hawai`i County Code. Resolution No. 38-11 authorized the lease of certain County of Hawai`i owned lands, and requires that the negotiated lease agreement for those lands be accepted by the County Council pursuant to Section 2-114(d) of the Hawai`i County Code. A proposed amendment was transmitted via Communication No. 248.2 by Chair Poindexter, dated April 26, 2013. The amendment was approved unanimously. The text of Resolution No. 106-13 is not altered in any way;just the terms of the lease as described by Ms. Crawford in Communication No. 248.1. There was no discussion on this measure. Pursuant to Section 2-114(d), Hawai`i County Code, the Council may require in the initial resolution that the negotiated agreement be accepted by the Council; also, pursuant to Section 10-10, Hawaii County Code, any contract or lease or other obligation requiring payment of funds from the appropriation of a later fiscal year must be approved by resolution.
