COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAII <br />BILL NO. 84 <br />AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 11, DIVISION 1, SECTION 24-302 <br />OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br />SPEED LIMITS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. The purpose of this measure is to establish speed limits in the Hawaii County <br />Code for the Hawaiian Paradise Park Subdivision so that speed limits can be properly enforced by the <br />police. Pursuant to Section 24-2 of the Hawaii County Code, the County shall not be responsible for the <br />maintenance and repair of any private street, highway, or thoroughfare when it imposes or enforces traffic <br />regulations and highway safety laws on that private street, highway, or thoroughfare. <br />SECTION 2. Chapter 24, Article 11, Division 1, Section 24-302, Schedule 6. 35 mile per <br />hour limit, subsection (g), Puna, of the Hawaii County Code 1983 (2005 Edition, as amended), to be <br />amended by adding new item and renumbering as required: <br />() Hawaiian Paradise Park Subdivision, Shower Drive, Kaloli Drive, Paradise Drive and <br />Makuu Drive. <br />SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. <br />In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be <br />included. <br />SECTION 4. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or application, <br />and to this end, the provisions of this ordinance are declared to be severable. <br />
