RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM <br /> KEANALEHU DRIVE THRU THE PROPOSED PHASE 1 — `AKAU DEVELOPMENT OF <br /> THE LA`I`OPUA VILLAGE 4 SUBDIVISION WITHIN TAX MAP KEYS 7-4-021:10 & <br /> PORTION OF 7-4-021:012, SITUATED IN KEALAKEHE, NORTH KONA, HAWAII FOR <br /> THE DEPARTMENT OF HAWAIIAN HOME LANDS. <br /> WHEREAS, applicant Department of Hawaiian Home Lands has requested to extend the <br /> public sewer in accordance with Section 21-26, Hawai`i County Code to service TMK 7-4-021:10 and <br /> a portion of 7-4-021:012, which is owned by the Department of Hawaiian Home Lands; and <br /> WHEREAS, applicant Department of Hawaiian Home Lands will bear the full cost of the <br /> extension and will be eligible to exercise conditions under Section 21-28(a), Hawai`i County Code, <br /> granting reimbursement to the applicant for 10 years after completion of the extension of one-half of <br /> all monies for sewer charges collected by the County from other properties, if any, connecting to the <br /> extension provided that the total of such reimbursement shall not exceed the cost incurred by the <br /> applicant to construct the extension; and <br /> WHEREAS, the reimbursable public sewer extension is from the connection to the existing <br /> sewer main stubouts at the Keanalehu Drive—Maua Place and Keanalehu Drive-Ko`oko`olau Street <br /> intersections, and sewer infrastructure within the proposed road right-of-ways of the Phase 1—'Akau <br /> development which is to be dedicated to the County via a separate resolution; and <br /> WHEREAS, the proposed sewer infrastructure within Phase 1—`Akau will allow for future <br /> connection of Phase 2—Hema at the Ohemakai Street—Ko`oko`olau Street intersection which will <br /> require a separate resolution for sewer extension; and <br /> WHEREAS, upon final acceptance of the Phase 1—`Akau sewer extension, it will become part <br /> of the Public Sewer System and will become the responsibility of the County of Hawai`i Wastewater <br /> Division to maintain; and <br /> WHEREAS, the Director of Environmental Management has recommended approval of the <br /> extension according to Section 21-27, Hawai`i County Code; and Attachment "A" is an application for <br /> sewer extension from the Department of Hawaiian Home Lands with a location map; and <br /> WHEREAS, sewer extensions are beneficial to the community by reducing the amount of <br /> potential pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier <br /> environment; and <br /> WHEREAS, Section 21-26.1, Hawai`i County Code, provides that the Council has authority to <br /> approve all public sewer extensions; now, therefore, <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that the public sewer extension from Keanalehu Drive thru the Phase 1—`Akau development <br /> of the La`i`opua Village 4 Subdivision, as delineated and described in Attachment "A" is hereby <br /> approved. <br />
