<br /> AN ORDINANCE PROVIDING FOR THE COST OF WATER SYSTEM
<br /> IMPROVEMENTS IN "IMPROVEMENT DISTRICT NO. 19 - KONA OCEAN VIEW
<br /> PROPERTIES SUBDIVISION," DISTRICT OF NORTH KONA, COUNTY OF HAWAII,
<br /> FIXING THE PORTION OF THE COST TO BE ASSESSED AGAINST BENEFITED
<br /> ASSESSMENT UNITS, ADOPTING FINAL ASSESSMENT ROLL, IMPOSING
<br /> ASSESSMENT LIEN AGAINST EACH ASSESSMENT UNIT ASSESSED ACCORDING
<br /> TO THE ASSESSMENT, PROVIDING FOR PAYMENT OF ASSESSMENTS IN
<br /> INSTALLMENTS, AND AUTHORIZING FURTHER ACTIONS BY THE DIRECTOR OF
<br /> FINANCE.
<br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`L•
<br /> SECTION 1. Preliminary Proceedings Confirmed. The Council of the County of Hawai`i
<br /> does hereby adopt, approve and confirm all and singular proceedings heretofore had and taken
<br /> under Chapter 12, Hawai`i County Code 1983 (2005 Edition, as Amended), with respect to the
<br /> creation of"Improvement District No. 19 - Kona Ocean View Properties Subdivision," District
<br /> of North Kona, County of Hawai`i (the "Improvement District"), and the making of certain
<br /> proposed water system improvements (the "Improvements"), all as set forth and described in:
<br /> Resolution No. 47-07 "Resolution Relating to a Council Initiated Improvement District to
<br /> Facilitate Construction of Permanent Improvements to the Kona Ocean View Properties
<br /> Subdivision, at Pu'ukala, North Kona, Hawaii, Including Improvement of the Water Distribution
<br /> System to County Standards, in Accordance with Chapter 12 of the Hawaii County Code 1983
<br /> (2005 Edition, as Amended) Relating to Improvements by Assessments," adopted February 22,
<br /> 2007; Resolution No. 74-11, "A Resolution Rescinding Resolution No. 41-11 and to Propose the
<br /> Establishment of a Water System Improvement District for the Kona Ocean View Properties
<br /> Subdivision Resolution," adopted May 17, 2011, including the exhibits attached thereto;
<br /> Resolution No. 99-11, "A Resolution of Determination to Proceed to Create and Define a Water
<br /> System Improvement District for Kona Ocean View Properties Subdivision," adopted August 3,
<br /> 2011, including the exhibits attached thereto; Resolution No. 301-12, "A Resolution to Approve
<br /> and Adopt a Corrected Map of the Special Improvements to be Constructed or Improved,
<br /> together with Final Details, and Plans and Specifications for a Water Delivery System for the
<br /> Kona Ocean View Properties Subdivision," adopted September 19, 2012, including the exhibits
<br /> attached thereto; Resolution No. 98-13, "A Resolution Acknowledging Receipt of a Corrected
<br /> Map, Preliminary Assessment Roll, Description of Assessment Units to be Assessed and
<br /> Construction Contract Bid of the Lowest Responsible and Reliable Bidder for a Water System
<br /> Improvement District for the Kona Ocean View Properties Subdivision, and Setting the Date,
<br /> Time, and Place of a Public Hearing to be Held Concerning such Items pursuant to Section 12-
<br /> 27, Hawaii County Code 1983 (2005 Edition, as Amended)," adopted May 1, 2013, including
<br /> the exhibits attached thereto; and the Final Assessment Roll attached as Exhibit "A"hereto; to all
<br /> of which documents reference is hereby made for a more particular and detailed description of
