• COUNTY OF HAWAII '•_ �" �• STATE OF HAWAII RESOLUTION NO. 206 13 RESOLUTION AUTHORIZING THE MAYOR TO PROVIDE EASEMENTS, LICENSES, PERMITS OR OTHER AUTHORIZATION REASONABLY NECESSARY FOR THE LEASES ON LOT 3A (TAX MAP KEY NO. [3] 2-4-001-177) AND LOT 3B (TAX MAP KEY NO. [3] 2-4-001-184). WHEREAS, by Resolution No. 709 08, the Council authorized the lease of the land in Hilo, Hawaii that was transferred to the County of Hawai'i by the Governor of the State of Hawai'i by Executive Order 4224 for the purpose of planning, developing and operating affordable rental housing for senior citizens and authorized the Mayor to execute said Lease with Hawai'i Island Community Development Corporation ("HICDC"); and WHEREAS, said Lease was thereafter executed by the Mayor and HICDC; and WHEREAS, in order to develop the first phase of the affordable rental housing for senior citizens, HICDC formed a new entity, Mohouli Senior Housing Phase 1 LLLP ("Mohouli Senior") whose general partner is a wholly owned subsidiary of HICDC; and WHEREAS, the initial Lease between the County of Hawai'i and HICDC was amended to allow Mohouli Senior to lease the upper portion of said land (which became Lot 3A Tax Map Key No. [3] 2-4-001-177) and to allow HICDC under the initial Lease to continue planning and development for later phases of development on the lower portion of said land (which became Lot 3B Tax Map Key No. [3] 2-4-001-184); and WHEREAS, Mohouli Senior is completing construction of 60 affordable rental units for senior citizens on Lot 3A; and WHEREAS, in order to use the leased areas, Mohouli Senior and HICDC need to have various easements for access and utility purposes provided for Lots 3A and 3B and may require licenses or other authorizations affecting said lots to allow use of the leased areas; now, therefore,
