RESOLUTION PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTIES BY
EMINENT DOMAIN, BEING PORTIONS OF TAX MAP KEY: (3) 8-1-09: 34 & 52
(PARCEL 22), 33 & 49 (PARCEL 23), 03, 50 & 51 (PARCEL 24), 08 (PARCEL 27) AND 07
(PARCEL 28), SITUATED AT KA`AWALOA, SOUTH KONA, COUNTY AND STATE OF
HAWAII, FOR THE DEVELOPMENT AND CONSTRUCTION OF MAMALAHOA
BYPASS ROAD, JOB NO. E-4163, AND NAPO`OPO`O ROAD/MAMALAHOA HIGHWAY
IMPROVEMENTS, JOB NO. E-4614
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, a bypass highway has been planned and is being developed to run makai of
the Mamalahoa Highway from the area of Keauhou to its terminus with the Mamalahoa Highway
in the vicinity of Napo`opo`o Road;
WHEREAS, the Kona Regional Plan identified the current Mamalahoa Highway as
inadequate to handle the volume of traffic currently traversed on the roadway; and
WHEREAS, the proposed Mamalahoa Bypass Highway has been determined by the
County of Hawai`i, through its County Council, as providing a regional benefit for a public
purpose and use which will benefit the County of Hawai`i; and the adjacent areas, and will better
serve the region's future development and project traffic demands; and
WHEREAS, the northern segment of the Mamalahoa Bypass Highway, from Keauhou to
the vicinity of the intersection of Haleki`i Street and Mamalahoa Bypass Highway has been
completed and dedicated to the County of Hawai`i; and
WHEREAS, the development and completion of the construction of the Mamalahoa
Bypass Highway, that is, Mamalahoa Bypass Highway (Job No. E-4163) and Napo`opo`o
Road/Mamalahoa Highway Improvements (Job No. E-4614), would entail the acquiring by the
County of Hawai`i of additional lands described as follows in: Exhibits "1," legal description,
and "2," parcel map, attached hereto and made a part hereof, for Parcel 22 consisting of 0.619
acre, more or less; Exhibits "3," legal description, and "4,"parcel map, attached hereto and made
a part hereof, for Parcel 23 consisting of 2.303 acres, more or less; Exhibits "5," legal
description, and"6,"parcel map, attached hereto and made a part hereof, for Parcel 24 consisting
of 4.079 acres, more or less; Exhibits "7," legal description, and"8,"parcel map, attached hereto
and made a part hereof, for Parcel 27 consisting of 0.200 acre, more or less; Exhibits "9," legal
description, and "10,"parcel map, attached hereto and made a part hereof, for Parcel 28
consisting of 0.021 acre, more or less; and together with any adjacent lands necessary for
temporary construction purposes, including but not limited to, temporary easements for
construction and operations, storage and disposal areas; and
WHEREAS, the completion of the new highway has been determined by the County of
Hawai`i as providing a regional public use and purpose which will benefit the County of
Hawai`i; and
WHEREAS, the County of Hawai`i deems it necessary to invoke its condemnation
powers in acquiring the additional lands to complete the new highway; and
WHEREAS, Section 101-13 of the Hawai`i Revised Statutes requires that a
condemnation action by the County of Hawai`i must be authorized by a resolution of the County
Council.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the
Council of the County of Hawai`i finds that it is necessary for the public use and purpose for the
benefit of the County of Hawai`i, to wit: the development and completion of the construction of

the Mamalahoa Bypass Highway, at Ka`awaloa, in the District of South Kona, County and State
of Hawai`i, to take, acquire and condemn the additional lands described as follows in: Exhibits
"1," legal description, and"2,"parcel map, attached hereto and made a part hereof, for Parcel 22
consisting of 0.619 acre, more or less; Exhibits "3," legal description, and "4,"parcel map,
attached hereto and made a part hereof, for Parcel 23 consisting of 2.303 acres, more or less;
Exhibits "5," legal description, and"6,"parcel map, attached hereto and made a part hereof, for
Parcel 24 consisting of 4.079 acres, more or less; Exhibits "7," legal description, and "8,"parcel
map, attached hereto and made a part hereof, for Parcel 27 consisting of 0.200 acre, more or less;
Exhibits "9," legal description, and "10,"parcel map, attached hereto and made a part hereof, for
Parcel 28 consisting of 0.021 acre, more or less; and together with any adjacent lands necessary
for temporary construction purposes, including but not limited to, temporary easements for
construction and operations, storage and disposal areas.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the Corporation Counsel of the County of Hawai`i be and is hereby authorized
and empowered to initiate proceedings in eminent domain, as provided by law, for the taking,
acquisition and condemnation of the aforesaid land.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the process of said proceedings in eminent domain, the Corporation Counsel be
and is hereby authorized and empowered to negotiate terms of settlement, subject to Section 2-
10, Hawai`i County Code, and the approval of the Court before which such proceedings are
prosecuted.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed to
transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of

Hawai`i; (2) the Department of Public Works; (3) to all subject landowners; and (4) Senior
Deputy Corporation Counsel Joseph K. Kamelamela.

RESOLUTION PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTIES BY EMINENT
DOMAIN, BEING PORTIONS OF TAX MAP KEY: (3) 8-1-09: 34 & 52 (PARCEL 22), 33 &49
(PARCEL 23), 03, 50 & 51 (PARCEL 24), 08 (PARCEL 27) AND 07 (PARCEL 28), SITUATED AT
KA`AWALOA, SOUTH KONA, COUNTY AND STATE OF HAWAII, FOR THE DEVELOPMENT
AND CONSTRUCTION OF MAMALAHOA BYPASS ROAD, JOB NO. E-4163, AND
NAPO`OPO`O ROAD/MAMALAHOA HIGHWAY IMPROVEMENTS, JOB NO. E-4614
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII.
WHEREAS, a bypass highway has been planned and is being developed to run makai of the
Mamalahoa Highway from the area of Keauhou to its terminus with the Mamalahoa Highway in the
vicinity of Napo`opo`o Road;
WHEREAS, the Kona Regional Plan identified the current Mamalahoa Highway as inadequate
to handle the volume of traffic currently traversed on the roadway; and
WHEREAS, the proposed Mamalahoa Bypass Highway has been determined by the County of
Hawai`i, through its County Council, as providing a regional benefit for a public purpose and use which
will benefit the County of Hawai`i; and the adjacent areas, and will better serve the region's future
development and project traffic demands; and
WHEREAS, the northern segment of the Mamalahoa Bypass Highway, from Keauhou to the
vicinity of the intersection of Haleki`i Street and Mamalahoa Bypass Highway has been completed and
dedicated to the County of Hawai`i; and
WHEREAS, the development and completion of the construction of the Mamalahoa Bypass
Highway, that is, Mamalahoa Bypass Highway (Job No. E-4163) and Napo`opo`o Road/Mamalahoa
Highway Improvements (Job No. E-4614), would entail the acquiring by the County of Hawai`i of
additional lands described as follows in: Exhibits "1," legal description, and "2," parcel map, attached
hereto and made a part hereof, for Parcel 22 consisting of 0.619 acre, more or less; Exhibits "3," legal
description, and "4,"parcel map, attached hereto and made a part hereof, for Parcel 23 consisting of
2.303 acres, more or less; Exhibits "5," legal description, and "6," parcel map, attached hereto and made
a part hereof, for Parcel 24 consisting of 4.079 acres, more or less; Exhibits "7," legal description, and
"8," parcel map, attached hereto and made a part hereof, for Parcel 27 consisting of 0.200 acre, more or
less; Exhibits "9," legal description, and"10," parcel map, attached hereto and made a part hereof, for
Parcel 28 consisting of 0.021 acre, more or less; and together with any adjacent lands necessary for
temporary construction purposes, including but not limited to, temporary easements for construction and
operations, storage and disposal areas; and
WHEREAS, the completion of the new highway has been determined by the County of Hawai`i
as providing a regional public use and purpose which will benefit the County of Hawai`i; and
WHEREAS, the County of Hawai`i deems it necessary to invoke its condemnation powers in
acquiring the additional lands to complete the new highway; and
WHEREAS, Section 101-13 of the Hawai`i Revised Statutes requires that a condemnation action
by the County of Hawai`i must be authorized by a resolution of the County Council.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Council of
the County of Hawai`i finds that it is necessary for the public use and purpose for the benefit of the
County of Hawai`i, to wit: the development and completion of the construction of the Mamalahoa
Bypass Highway, at Ka`awaloa, in the District of South Kona, County and State of Hawaii, to take,
acquire and condemn the additional lands described as follows in: Exhibits "1," legal description, and
"2," parcel map, attached hereto and made a part hereof, for Parcel 22 consisting of 0.619 acre, more or
less; Exhibits "3," legal description, and "4,"parcel map, attached hereto and made a part hereof, for
Parcel 23 consisting of 2.303 acres, more or less; Exhibits "5," legal description, and "6," parcel map,
attached hereto and made a part hereof, for Parcel 24 consisting of 4.079 acres, more or less;
Exhibits "7," legal description, and "8,"parcel map, attached hereto and made a part hereof, for

BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Corporation Counsel of the County of Hawai`i be and is hereby authorized and empowered to initiate
proceedings in eminent domain, as provided by law, for the taking, acquisition and condemnation of the
aforesaid land.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
process of said proceedings in eminent domain, the Corporation Counsel be and is hereby authorized
and empowered to negotiate terms of settlement, subject to Section 2-10, Hawai`i County Code, and the
approval of the Court before which such proceedings are prosecuted.
BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed to
transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of
Hawai`i; (2) the Department of Public Works; (3) to all subject landowners; and (4) Senior Deputy
Corporation Counsel Joseph K. Kamelamela.
