HomeMy WebLinkAboutRES 261 Draft 01 2012-2014 .;::NSV Oi M• COUNTY OF HAWAII • _ ,j;� :• STATE OF HAWAII RESOLUTION NO. 261 1 4 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE U.S. FISH AND WILDLIFE SERVICE, PURSUANT TO HRS 46-7, TO SUPPORT WILDLAND AND STRUCTURAL FIREFIGHTING SERVICES WITHIN THE BIG ISLAND NATIONAL WILDLIFE REFUGE COMPLEX WHEREAS, the Hakalau Forest National Wildlife Refuge (NWR) and Kona Forest NWR, which are within the boundaries of the Big Island National Wildlife Refuge Complex, are situated in areas with a high fire hazard; and WHEREAS, the Hawaii Fire Department works collaboratively with the U.S. Fish and Wildlife Service to mitigate fires in these areas; and WHEREAS, the agreement, a Memorandum of Understanding (MOU), identifies the terms and conditions of the collaboration identified above, and provides clarification of each jurisdiction's responsibilities; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that County departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawai'i Revised Statutes, that the Mayor of the County of Hawai'i is authorized to execute, on behalf of the County, an agreement, of which a draft is attached hereto and incorporated herein by reference as Exhibit "I", and related documents with the U.S. Fish and Wildlife Service, to identify the terms and conditions, and provide clarification of each jurisdiction's responsibilities. BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Office of the Mayor, the Hawaii Fire Department and the Finance Department. The objective of this agreement is to identify the terms and conditions under which the purpose will be carried out. Authority for the Service to participate in this Memorandum of Understanding (MOU) is provided in the Fish and Wildlife Act of 1956 (16 USC 742) and the Fish and Wildlife Coordination Act(16 USC 661-667). The Cooperator enters this agreement pursuant to the authority provided by the regulations governing the Hawaii Fire Department. The parties hereto agree as follows: The Hawaii Fire Department will: 1) Respond immediately upon notification by any individual or agency of a wildland or structural fire on Service lands. 2) Provide as available,the manpower, equipment and expertise for suppression of wildland fires on Service lands under the direction of the Cooperator Fire Chief and in cooperation with the Refuge Manager. 3) Provide as available, the manpower, equipment and expertise for suppression of structural fires on Service lands under the direction of the Cooperator Fire Chief and in cooperation with the Refuge Manager. A list of structures on the Refuge is included as Attachment B. 4) Request suppression assistance from State and Federal agencies for large fires on Service lands if the Cooperator is unable to provide sufficient manpower and equipment to extinguish the fire. 5) At the first indication of a wildland fire(or other emergency) on Service lands, provide immediate notification to the Refuge Manager at the telephone number listed below. The Service will: 1) Provide available staff and equipment to suppress fires on Service lands at the request of the Hawaii Fire Department. 2) Delegate command authority to the Cooperator Fire Chief or his designee during wildland and structural fire suppression activities by the Cooperator on Service lands. 3) Provide advice to the Cooperator Fire Chief relative to best access route to the fire, location of roads and natural features that might service as fuel breaks, location of water sources on or near the Refuge, fuel types on the Refuge, areas with particular resource value and deserving of special protection, etc. 4) Reimburse the Cooperator and assist State agencies for firefighting services at prevailing rates. MOU Template-March 2012 MOU between Big Island NWRC and Hawaii Fire Department This agreement involves no exchange of funds between the parties until such time as services are rendered. Payments will be made via electronic fund transfer upon receipt of invoice based on actual expenses for fire suppression, control and mop-up. Modifications to this memo of understanding may be proposed by either party and shall become effective upon written concurrence of the parties. This agreement may be terminated by any party following 30 days written notification to other party(s). Upon request and to the full extent permitted by applicable law,the agencies will share with each other final reports of incidents involving both agencies. Unless otherwise agreed to in writing by the agencies, any property furnished by one agency to the other will remain the property of the furnishing agency. Any property furnished by the Service to other agencies during the performance of this agreement will be used and disposed of as set forth in Service Porperty Management Regulations.
