.'�Q'•'`v��Mme'', COUNTY OF HAWAII :•:� '; � •� STATE OF HAWAII RESOLUTION NO. 271 14 RESOLUTION AUTHORIZING THE ACCEPTANCE OF A MONETARY DONATION OF $2,000,000 TO THE COUNTY OF HAWAI`I'S PUBLIC ACCESS, OPEN SPACE AND NATURAL RESOURCES PRESERVATION FUND WHEREAS, the County of Hawaii, hereinafter "County", on August 1, 2012 in Resolution 276-12 authorized the Director of Finance to enter into negotiations for the purchase of the coastal land known as `O`oma II in the District of North Kona, County and State of Hawaii, Tax Map Key (3) 7-3-009:004; and WHEREAS, the Department of Finance is in the process of acquiring said land utilizing funds from the Public Access, Open Space and Natural Resources Preservation Fund; and WHEREAS, Kohanaiki Shores, LLC, a foreign limited liability company, on December 18, 2013, proposed to donate to the County of Hawaii Two Million Dollars to assist the Public Access, Open Space and Natural Resources Preservation Fund in the acquisition of`O`oma II, Tax Map Key (3) 7-3-009:004; and WHEREAS, Article XIII, Section 13-12, of the Hawaii County Charter provides that the Council, on behalf of the County, may accept gifts of donations of money, securities or other personal property or of real estate or any interest in real estate, and Chapter 2, Article 30, Section 2-162 (a) of the Hawaii County Code states that any gifts or donations of money, securities, or personal property which fall within the capitalization procedures of the Department of Finance, may be accepted by Resolution approved by the Council; and WHEREAS, the Hawaii County Department of Finance has requested that cash donations of any amount be recorded and accepted through the formal Resolution process; and WHEREAS, the Department of Finance recommends the acceptance of this donation; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with Article XIII, Section 13-12, of the Hawaii County Charter, and Chapter 2, Article 30, Section 2-162(a) of the Hawaii County Code, the Council of the County of Hawaii accepts this donation to the County of Hawai`i's Public Access, Open Space and Natural Resources Preservation Fund to assist in the acquisition of `O`oma II, Tax Map Key (3) 7-3-009:004.
