�J�<Y Os M, , <br /> COUNTY OF HAWAII ' '�'�� ' �"" STATE OF HAWAII <br /> art os'N► <br /> • <br /> BILL NO. 225 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 11, DIVISION 1, SECTION 24-299 <br /> OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br /> SPEED LIMITS ON PRIVATE STREETS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. The purpose of this ordinance is to establish speed limits in the Fern Acres <br /> subdivision so that speed limits can be properly enforced by the police. Pursuant to Section 24-2 of the <br /> Hawai`i County Code, the County shall not be responsible for the maintenance and repair of any private <br /> street, highway, or thoroughfare when it imposes or enforces traffic regulations and highway safety laws <br /> on that private street, highway, or thoroughfare. <br /> SECTION 2. Chapter 24, article 11, division 1, section 24-299, schedule 3. 20 mile per hour <br /> limit, subsection (g) of the Hawai`i County Code 1983 (2005 Edition, as amended), is amended to read <br /> as follows: <br /> "(g) Puna <br /> (1) Fern Acres Subdivision <br /> 1. All streets." <br /> SECTION 3. New material is underscored. In printing this ordinance, the underscoring need <br /> not be included. <br /> SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any <br /> person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications <br /> of the ordinance which can be given effect without the invalid provision or application, and to this end, <br /> the provisions of this ordinance are declared to be severable. <br /> SECTION 5.
