REQUEST: <br /> Resolution to amend Item 1.13 in the List of Preemptions provided in "Exhibit C" attached to Resolution No. <br /> 416-07, which waives the requirements of Section 25-5-7 (Hawai'i County Code) pertaining to minimum <br /> yards. <br /> B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): <br /> WHEREAS, on September 7, 2006, the Hawai'i County Council adopted Resolution No. 439-06, which <br /> designated the Waikoloa Workforce Housing Project as an "Experimental and Demonstration Housing <br /> Project" as provided by Section 46-15, Hawai'i Revised Statutes (HRS) <br /> Resolution No. 439-06, Exhibit C List of Preemptions, Item 3.10 stated "except for building sites gaining access <br /> from an alley, in which case the minimum yards shall be five (5) feet for the front yard facing the alley". <br /> Resolution 416-07 amended the List of Preemption, and inadvertently removed the description of the building <br /> sites gaining access from an alley. <br /> The Housing Administrator request to amend Item 1.13 in Exhibit C List of Preemption, of Resolution 416-07 to <br /> include the language for building sites gaining access from an alley to have the five (5) feet minimum yard. <br /> The draft resolution was reviewed and approved by the Planning Director as well as Corporation Counsel. <br /> SIGNED: AAA' DATE: 3--6-1(7 <br /> Department Head <br />
